So 5 years ago we hired Hess Kennedy, as you know, nothing was done. Now there appears to be a settlement, but our credit report is not updated and never has been. What do I do? The website for the receiver is now shut down. Also, am I going to get my settlement from them?

The Answer:
Dear Josh,
As far as getting any monetary settlement, you might not be entitled to any. There were not many fund to distribute after all was said and done. You’d have to contact the receiver or the office of the Attorney General for more information on that. [UPDATE: See my comment below on fund distributions.]
As far as getting your credit report updated, I’m not quite sure what you are asking about. If you are asking that your creditor report was not cleaned up after being in the program, it won’t be. If you are saying that your account still shows debts being open that you settled, then use a consolidated credit report to find out which credit bureaus are reporting the incorrect information and send them a letter disputing it. The contact information will be on the consolidated credit report you download.
In my interview “An Interview With Dan Stermer, the Court Appointed Receiver for the Hess Kennedy Debt Settlement Law Firm in Florida – Get Out of Debt Podcast” the receiver mentions that a couple of creditors agreed to clear the information from the credit report as part of the settlement. But don’t get your hopes up that all will do that. It was a one-time and exceptional event that a couple of creditors agreed to do that at all.
