When I asked Ari Dinov of my refund, he claimed I missed 6 months of payments (and later said 3 months) therefore I breached the contract. I have bank records to prove him otherwise. I never missed a payment but rather sent 2 or more payments a month whenever I could work over time. I asked NoteWorld to send me a record of all my payments. I never got it. I was told to log-in into my account and I did. All it showed was a little over a thousand dollars in my name. Everything else were erased. My bank record shows about $17,000.00 was sent to NoteWorld since April 2009.
Why should I not believe that these companies are partners in crime?

Steve,

If only I am not embarrassed to tell the world how I was scammed, I would like to go on Judge Judy's show and sue Express Debt Relief, Jon Simon and NoteWorld. I believe it would be a good venue also to expose these people and their heartless activities. Maybe all those other people who thrashes you and say you don't know what you are talking about would realize they are the ignorant ones. Or maybe they already knew. They just want to save face.

RE-SIMON AND BOCKSCH

I had a very bad experience with this company. We used them to settle our debt and I ended up making most of the phone calls to the creditors and doing all the leg work myself. They do nothing as far as contacting your creditors unless you stay on top of them. We had 4 accounts that they were to settle and they only settled one without my assistance and this creditor had to actually call them. I was contacted by Bank Of America who stated that they had to contact them and now could not get the check by the date that they were promised which they were using Note world at the time to distribute checks. This started me to stay on top of things. In fact, the last account, I settled without them and all they had to do was provide me with a fax number so they could look over the settlement letter and release a check to them. Mary Pujol was handling our account and I had to leave at least 10 messages for her with no return call asking her if she had received the fax. She still never returned the call even after I called her main line and the main line to the office. I was even hung up on at least three times because I guess they have caller ID and got tired of me calling. If I had known then what I know now I would have dealt directly with the creditors myself and avoided the frustration of dealing with Simon and Bocksch and saved thousands of dollars for the huge fee that we were charged that I feel was not earned. Save your money and work with the creditors yourself. Also, I do not know who this person is that answers the phone and states that her name is Angie but she is not very helpful.
You voluntarily elected to enter into a contract with a Debt Settlement Company (“DSC”) to assist you with a reduction of your debt. At or about the same time, it is likely that you also entered into an agreement with NoteWorld to initiate electronic debit entries from your bank account to satisfy the amounts payable under the terms of your contract with your DSC. NoteWorld offers consumers, who have chosen to use a DSC to help them manage their debt, a payment option for the secure handling of their money. By selecting NoteWorld as a vehicle for payment processing, consumers are assured that their money is being handled by an objective third party who is not involved in negotiating debt settlements with their creditors. A consumer may opt-out of the servicing arrangement at any time with instruction to NoteWorld. Upon receipt of such instruction, the consumer’s account is closed and all remaining funds, if any, held by NoteWorld are remitted back to the consumer within two (2) business days. At all times, NoteWorld undertakes these obligations as an independent and objective third-party and does not act as an agent for the DSC. Moreover, NoteWorld provides these services to consumers for a nominal fee of not more than $12.50 per month.

NoteWorld is not a debt settlement company and did not enter into a contract with you to provide you with debt settlement services. As explained above, you likely signed an Automatic Withdrawal (ACH) Sign-Up Form authorizing and requesting that NoteWorld withdraw a specific sum of money from your bank account each month. Your Sign-Up Agreement was valid and NoteWorld adhered to your instructions pursuant thereto. You did not contract with NoteWorld to pay off your debts or provide any other debt settlement services. You simply engaged NoteWorld to process your monthly payments and to provide a safe and secure trust account for the money you voluntarily committed for the purpose of paying the debts you owed.

Please make note of the fact that NoteWorld is licensed as a Money Transmitter in Minnesota. Since NoteWorld is not a debt settlement company, licensure as a Minnesota Debt Settlement Services Provider is not appropriate or required.

If you would like to contact us directly, we would be happy to address any further concerns you might have regarding NoteWorld’s handling of your money. In addition, we would be happy to provide you with a full accounting of the monies that you voluntarily authorized NoteWorld to withdraw from your bank account.
