Swithrock Financial has supposedly been working on my debts for over a year. I was subpoenaed to court for one debtor and Swiftrock stated that they had taken care of it. I got a notice today (taped to my front door when I got home from work) that my paycheck is being garnished.
Swiftrock currently is getting $523.00 a month from me to handle things and I don’t believe they are doing anything. I received another letter in the mail today from another debtor stating they had purchased my account and demand payment. I’ve been trying to contact Swiftrock and no one has gotten back to me.
What can I possibly do? Should I file bankruptcy? Can I get my money back from Swiftrock (It’s supposedly in a bank account). What can I do with the garnishment?

Dear Peggy,
Wow, it’s a long way from “we took care of it” to getting your wages garnished. To get to a garnishment you would have been sued, lost and then a garnishment approved by the court.
At this point you probably will go bankrupt to kill the garnishment, prevent any additional lawsuits, and stop all collection calls. Bankruptcy will run you about $1,500 for a Chapter 7. I’m sure that is much cheaper than what you paid them.
You can click here to find a local bankruptcy attorney. When you go talk to the attorney you might want to show them this other case against Debt Settlement USA. In this case the bankruptcy trustee went after the debt settlement company for all the paid for services, plus damages.
