Will Citibank Really Take Me to Court? – Kathy

Several credit cards from years of build up. Totally approximately 50,00.00. Went into a debt relief program with complete debt services for a year. They settled two small ones. A week ago I got served with a summons from Citibank for 12,000.00. I panicked and called a bankruptcy attorney and decided that was the route to go.

I answered the summons just this week with help from the bankruptcy attorney. The bankruptcy attorney also advised me to get out of the debt relief program – I was paying $589.00 a month ( I only bring home $1240 a month). Because my husband makes too much money and our home is worth $200,000 I decided bankruptcy was not the way to go. Now, we are going to talke out a home equity loan to clear this up hopefully.

What are the odds Citibank will take me to court? Also can I negotiate with the collection agencies to get my balance down to pay off. If so, what would be the best way to go about it – through the mail? Can I ask to see my statements and agreement? I know I have asked more than one question, but any help you can give me is appreciated. This is New York State law.
