DebtPro123 Refuses to Give Me a Refund and Says I Can Only Cancel if I Agree to No Refund. – Mary

“Dear Steve,

I signed up with Debtpro 123 to consolidate credit card debt. I now have credit card companies using lawyer to get judgements against me. Why? Because no one has contacted them.

I was told by Debtpro 123 not to speak to my creditors, therefore I did speak to them or tell them I was using their services. Debtpro did not contact them. When I spoke to debtpro 123 in March 2011 about this I was told that I needed to fill out a power of attorney form first.

I signed up for their services in September of 2010. The power of attorney form was not sent out to me until March 2011. That is 7 months that my creditors heard nothing, it is no wonder why have gotten lawyers.

Now I am trying to cancel their services and they said I have to sign a notice of cancellation or they won’t cancel.

I have sent a letter canceling their service by certified mail and they said it will only be canceled if I sign their document waiving any refund to me.

And worst of all, when I asked for the manager, they would not transfer me and when I asked for her name they would only give me her first name and refused to give me her last name. I can go to any McDonald and get the full name of the manager.

Do I have to sign their “notice of cancellation”, or can I cancel the agreement by sending a letter requesting them to cancel?

Also, on the notice of cancellation it states “To rescind (cancel) this agreement, mail of fax a signed, dated copy of this rescission notice, or any other written cancellation notice to:

*I noticed it said “or”, so that makes me think I can cancel with just a written request.

The Answer

Dear Mary,

I think the real issue is if you received the benefit of the money you paid in services Provided by DebtPro123.

Frankly I think it is utterly ridiculous that they are asking you to sign a form saying you can cancel but you don’t get any refund. At the very least you should have a conversation with them regarding the return of your money for the services they did not deliver to you.

I’d start first by following the entire refund process I lay out here. If they don’t want to give you a fair and reasonable refund then I’d take this all the way.

As of the moment I’m writing this, DebtPro123 has an F rating with the BBB so others have filed complaints as well. – Source

    Mary, for DebtPro123 to not issue you a POA to sign for 7 months clearly states they made no efforts to contact your creditors. A POA is like the steering wheel in your car. you wont get far without it in the debt settlement world.

    I have a couple questions:

    (1) how much did you pay each month and what of that went to fees?

    (2) what were the “sales pitches” that were made to you at the time of enrollment? Estimated savings you would experience in the program, etc..

    (3)did your money go into a trust account or holding account, or did you pay them directly?

    Let’s start here. I will help you get your money back because it is schmucks like this that give the industry a bad name. And frankly, i have nothing better to do with an hour or two of my time than help you. no charge. I will get on the phone and conference call with you if needs be. I hate companies like this dabbling in what i consider “my industry” – not because we are the biggest, we aren’t. but because the foundation settlefirst is built on is the strongest. Unfortunately, your situation now being sued by what you implied is multiple creditors, is much more severe than what could have happened if you signed up with the right company. Regardless, now your number #1 priority is getting your money back. They did nothing to earn it and ill be damned if i let somebody get screwed by a debt settlement company and i know about it. And that goes for anyone else. my email is “[email protected]” and i will help anyone try to get a refund who feels they got screwed by a debt settlement company. Its just not right, and it needs to end. FIGHT BACK, I will help. Steve, are you down with this?

      Steve, my husband and I are in the same situation as Mary.  However, we now have 2 lawsuits pending and DebtPro123 wants us to sign the cancellation.  My question is, was Mary’s case ever resolved?  If so, is there any way I can find out how she was able to resolve it?  Thanks

        It does not appear that Mary commented further.

        You may want to talk to a local bankruptcy attorney first before you sign anything. A consumer bankruptcy will most probably stop the lawsuits and discharge your debt. 

        Has DebtPro123 promised you a certain amount of funds they may return if you sign the cancellation?

        No, we had an attorney send them a letter telling them we wanted to be removed from the program due to the fact that they had not done what they had been paid to do.  Bryan Taylor actually had a conversation with me and asked me to negotiate with one of my creditors that has a lawsuit against us and got upset with me when I asked about one of the other creditors!  I had a witness in the room when the conversation was going on.  Our attorney asked for the return of our $19,517.75 we had paid to them and the name of the agent for service of process for the state of WA since they are in CA.  He even asked for contact information of their attorney if they were represented by one.  The response we received from Mr. Taylor was that “have taken the appropriate steps under our bylaws pertaining to client “Cancellation” process. We have a very simple procedure of which is govern and dictated by industry guidelines.  We are not asking the consumer anything overbearing and broad reaching.”  He then went on the tell our attorney that he felt he was interfering with contractual business between cient and their firm and they have serveral levels of liablity of which they require the client to release and revoacte as well.  He stated that they have not need to retain our monies as it serves not benefit or reward.  He even put in his letter to an attorney and I quote, “Furthermore, we feel once monies have changed hands and our termination is completed there is not need for future endeavors or simply put..rocking throwing, as we only wish to safe guard against these potential matters.”  However, if I sign the cancellation then according to Bryan Taylor the funds that were available to my husband and I were $10,244.15 as of August 2011 and an additional payment of $1445.00 was made in September 2011, but not all of that goes into the account we now know.  So that means that DebtPro123 would be keeping over $8,000 for doing NOTHING!  They never contacted my creditors except for 1 and then asked me to negotiate with them.  The other 4 creditors never heard of them.  We have already reported them to the BBB in CA and they would not respond to the complaint.  It is really hard to get an attorney in CA because I am in WA.  I am afraid to sign the cancellation and then they don’t send me the full amount we are owed.

        Wow. That seems like a silly position for them to take. Is your attorney in Washington willing to proceed against them. I’m assuming you live in Washington and in that case there are some very important issues that give you a tremendous advantage by filing in Washington. 

        Tell your attorney to look at the Washington Supreme Court ruling I covered here.

        As far as I’m concerned, there is no reason for you to waive any rights unless you feel the settlement is satisfactory and a reasonable resolution. 

        Additionally, you may wish to follow all the steps I outlined in this refund process.

        Please keep me posted. Based on what you’ve shared it just doesn’t seem fair. 

        If you submit a consumer complaint through the website I’ll ask them to publicly respond.
