We Have an IRS Payment Plan But My Husband Just Died. What Do I Do? – Maggie

“Dear Steve,

My husband recently passed away. I know I have to file taxes for him and I since we were married, but my question is do I still have to pay any taxes that we owed from previous years. He was making a payment once a month. Do I have to continue to do that? How do I find out what my next steps are.

Thanks,

Maggie”

The Answer

Dear Maggie,

I’m so sorry to hear about the loss of your husband.

I realize this is a confusing time for you with so much to deal with. Since you already have a payment plan in place you should contact the IRS and explain the situation to them. You can call 1-800-829-1040 Monday – Friday and speak to an IRS representative.

They may alter your payment plan based on the change in possible household income.

The underlying question is if this tax liability was a joint liability or just your husband’s. I know you said “we” but it’s a very important point that needs clarification.

Please post your responses and follow-up messages to me on this in the comments section below.

Big Hug!
