“Some money for refunds is available for those who paid money for mortgage modification or foreclosure relief to Secure Property Solutions, Joseph A. Gembala III, or any of their contractors and marketers.
Over the last four years, I’ve tried to get a class certified that would cover all 1,008 customers of Joe Gembala and Secure Property Solutions. Thanks to those of you who filed grievances with the Pennsylvania Bar, Joe Gembala agreed to a two-year suspension of his law license, although he will likely never get it back at all, because he is supposed to among other things pay restitution to the people who complained, and he hasn’t even tried.
But in federal court, even though we submitted the Gembala suspension order in which he admitted under oath to conspiring with Mike Malone and others to charge advance fees for false promises and then not do any work and just keep the money, the federal judge unbelievably said this was not any evidence of wrongdoing and she was inclined to dismiss the case against him. Certainly, she was not going to certify any class action. After four years of work, that was a shade disappointing.
Okay, we have a serious problem with our federal judiciary. Still and all, Joe’s malpractice insurer would be stuck defending a lot of individual suits, so they have said they will talk settlement with any former Secure Property Solutions customers. I can’t guarantee money back, and I’m not sure how many people we can take care of, but for those of you who want some money back, please give me a call and for a one-third contingent fee (you pay no money and I only get a one-third share of any recovery) I’ll be glad to see what I can do for you.
I can tell you we have settled at least two cases this way and a number of other cases are being negotiated from among people who contacted me back in 2010. I’ve contacted all of those people whose contact information I still have, and not all of them returned the message.
