“Dear Steve,
I have a total of $26,000 in credit card debt that I got before I was recently married in 2008. We live in an apartment, we both own our own cars. We have no savings of any kind period – except for our very low checking account. I am not working, he is, and my unemployment has recently been exhausted. I can’t manage to pay monthly payments at all, and I have redeemed my 401 (k) money to pay off some of it.
Should I file bankruptcy? If so, can the creditors or courts take my husband’s wages or take my car/furniture? I have nothing to give them.
Thank you.
Leslie”
The Answer:
Dear Leslie,
If you only included debt that is your sole responsibility in your invdividual bankruptcy it will not involve your husband, his wages or his car.
Please contact a local bankruptcy attorney and schedule a free consultation to discuss the specifics about what bankruptcy will be like for you.
