I have debts and get calls all day long, but I’m to far behind to pay any of them. I just started back working part-time recently and I’m already about to have a pre confrence with another debt collector,but I know it will be more summons to come from others.

Can I tell debt collectors that i’m filing bankruptcy?

Dear Stephanie,

Well you can certainly tell them that you are planning to file bankruptcy but that’s not going to matter much. People lie about doing that all the time. What you really need to do is provide them with your bankruptcy case number and attorney information and that will take care of things.

    I would like to find out if i need to respond to a formal demand to pay a 2nd mortgage loan from a credit union, stating that I am filing bankruptcy in December. I can’t file bk until December since my 1st filing is less than 8 years before then. Do i tell the attorney that I’m filing bk on my response or just don’t answer the letter.       I would discuss this matter with your bankruptcy attorney. If you don’t have one yet, find one.
