I have a credit card loan from FGB (16,000dhs) and the bank file a case to me last year due to delayed payment i spend 10 days in jail and the court give me a fine of 2000 dhs.When i get out of the jail the bank still keep calling me saying i still have to pay which i did.I pay minimum amount montly,but recently someone from the bank calling me and saying that it&#039;s not enough he will file a civil case againts me if i didn&#039;t pay the whole amount so  i go to theyre offce and spoke to that guy and he said i should give new passport copy,labour card  copy,and salary statement and i should sign a letter saying i will pay full amount (how many months not mentioned) i did all of that today,but he ask me also a guarantor so that he can give me a 700dhs monthy he said if i didn&#039;t provide a guarantor within a week he will file a civil case againts me.
My question is in case a didn&#039;t find a guarator they can file a civil case for amount of 16,000dhs only?And the letter that i signed they can use that also to file a case to me in case i don&#039;t want to pay them anymore? becuase somebody tells me they cannot file a civil case not unless a have a loan of 100k above.</description>

		<description>Yes your debts would be waived as per policy in Dubai you can serve in prison to clear your debts if you have no money to pay the bank. The number of days that you will serve in prison will depend on the amount of money your borrowed from them and will depend on the judgement of the court. The court will ask you to settle the amount if you tell them that you cant then the court will decide for you. 		<description>Hi!  Steve.  I would like to ask an advice about my recent situation.  I have 2 credit cards recently from 2 banks in Dubai.  Over the last two months I am receiving lots of calls from the two banks (a law firm and a recovery department which are handling my case).  They are very harsh while dealing with this scenario.  I have even received a lot of threats from them.  They even sent an email to my current company about verification of my whereabouts warranting my outstanding balance is due which adversely affects my job and and my current status.  

Sad to say, I was not able to settle my accounts faithfully with the two banks due to the fact that I lost my parents last July 2011 in which I explained to them.  It is hard to live without parents as I am the bread winner of the family.  I have some obligations that I need to prioritize for the survival of my family.  This is one of the reasons why I have had some delinquent payments with unavoidable reasons.  

Relative to this, I have tried to attend the bank calls, replied their emails approaching of my financial recovery and never attempt to change my mobile numbers as I want to settle my dues as much as I could.  I have a bunch of replied emails which shows that I am willing to pay my debts (a total of 20,000 aed for one bank and a total of 8000 for the other bank) 

My personal debt really affects my job at this moment as I am experiencing sleepless nights &amp; anxiety. In order to get out of this issue I have paid some partial amount in one of my bank based on what we have agreed and promised to settle the outstanding balance through &quot;settlement plan&quot; starting next month.  

My questions are these... Do you think they have already filed a police case against me regarding my dues over the past few months considering I have already settled it with them? (2)  Are all my replied emails will be valid in the police/court on case they already raise this issue beforehand against me which shows that I am obliged to pay.

I just got home from work. I got a call from my fiance from his cell in Naif Police HQ , he said in 1 cell, 53 people including himself are held &amp; are all sharing , all from different nationalities, It&#039;s totally different from the previous prison he first went to. Since they are overcrowded, he and the others are sleeping on the floor - no mattress, blanket, nothing - just the cold, dirty floor. Anyway, 

He was advised that he &quot;only&quot;needs to pay AED 19k for his release or he can provide his passport as a deposit til he clears of the AED 19k. 

I called the police and asked how his case has been going, to my surprise the police said he was too busy on dealing with other case, so requested me to call him back after 1 hour.... - are they really like this???

and now im just wondering if my fiance handover his passport, should he ask FGB first to provide a written settlement/agreement??? </description>

his mobile was confiscated but still managed to borrow from police officers used theirs and called me, on the phone he told me food was nice there and place was clean. At midnight, he was transferred to Naif Police station and I brought him some clothes, blanket and food. He told me not to worry and he&#039;ll be fine..

He has an outstanding cc balance with FGB for 18k dhs. 6 months ago he tried negotiating everyday with FGB if they can give him resettlement, since 900dhs is the minimum he pays for almost 2 years and his balance never decrease anyway so why not settle for a repayment plan instead. Finally during that time he was able to speak with a lady from FGB and advised him  they can give him a resettlement if he pays 3.5k and the succeeding months would only be 500dhs...So, he paid 3.5k &amp; paid them 500 per month, then one day another collector from FGB called him and said he is not paying the min 900 dhs.. My fiance told them that they gave him a resettlement and he only needs to pay 500dhs. Guess what, this FGB collector is saying that they cancelled it. We asked the collector how much is his balance and it came up to 19.5k, so what happened to the first 3.5k &amp; succeeding 500 we paid he said to the collector. The collector only responded it was for the interest only. To my fiance&#039;s dismay, he didnt pay his monthly due with FGB.

Since last september 2011 he stopped paying his FGB card. Ofcourse collectors kept on calling him. He always advised the collectors, he would only pay if they can give a written repayment plan for him or atleast what they call &quot;installment shots&quot; but they always insisted to pay the minimum first then they will give him. Since they filed a case against him yesterday now he is in jail. I asked the police last night on what will happen, what would be the requirements of his release. The police told me that if he can provide his passport or someone else then they can release him. I tried to give my passport but they dont accept female passport. They said if a friend of his (man) then they can release him. Now, I am coordinating with my fiance&#039;s employer if they could release his passport immediately, but since it&#039;s weekend, we will have to wait.

		<description>Settling is always a possibility but YOU MUST get the agreement in writing first from the bank. Keep that and proof of payment together so if you need it in the future you will have it.

I would suggest you enter into a settlement agreement directly with the bank to avoid a future possible position that the collector did not have the authority to agree to those terms. In the UAE it is so important to make sure the paperwork is good and the creditor agrees since the last thing you want to do is be detained at the border or arrested.

I agree that using a third party in this case is a smart decision. A lawyer in your country or in the UAE would be a smart move.</description>

I have stories where Bilkish and other collectors took the money from debtors in their home country and never gave them NOC and settlement letter and after sometime they started harassing again. 

In another story i read that even after a guy settled the debts with bank, the bank didnt issue any settlement letter or NOC and the collectors are still harassing him. The bank guys just refuse to answer him. He wants to go back to Dubai but bank is not cooperating. 

Then what are the options left? While we are in our home country, shall we settle with collectors? or directly with bank? both are unreliable. 

One good suggestion i got that (while you are still in your home country) i should get a local lawyer to talk to bank as well as debt collectors instead of talking to them directly. If you are not able to reach any settlement with the bank, just dont settle it then. The lawyer should help you in getting rid of the collectors  harassment.

1st bad luck is that u took loan on sharjah visa, which is real bad coz in sharjah if they open case u wil not have a bail on ur passport or any ones.. but if ur case in dubai u stil have a chance to get bail at ur first min of arrest.. and 2nd its a very low amount 12k or 25k  the judgement will be very less for maximum of 2 months which u can appeal and challenge and get to month.. and 2nd possibility is to get fine by judge and free you … so u must be carrying some mount like 2000 aed to pay fine..

to stop u at airport they must passes civil judgements and then wait a month an then file the travel banned but if its police case then they can file in to police station and u wil e automaticaly wanted so u cant fly …or they can catch u at street by checking ur id or in car if u make an accident or else u r free bird to move around … .

		<description>well dear katrina , its simple the bank can make case in police as criminal or they can make case in civil either way you have to face the law , if it goes to police u have to pay or serve the sentance  according to ur loan , or 10% possibility to get fine and free,
if they go to civil  the judge will only look at real amount which u took as loan and pay in monthly basis no jail in this case . so not to worry  face it and get ride off the case…

Hi, My brother is in
Prison right now in Doha Qatar, we only
received an sms from him telling us to call the GM of his company before. I
already spoke to the General Manager, but he doesn’t have any idea because he has
more than 2,000 personnel working in their company. He gives me the number of
their HR and I spoke to him. According to him, my brother is terminated from
work due to poor performance; he is working in that company for more than
3years. The company gives him ticket for free to return in the Philippines, but my brother didn&#039;t return here
in the Philippines instead
he look for other work in Qatar.
The HR said that my brother have a loan, unpaid company telephone bills and he
need to compensate the tickets and so on...Wish I could talk to my brother to
ask the charges against him and how much does he owe to the company.  Please
give me some advice. I&#039;m so worried with my brother out there. Thank you.

		<description>Hi, I spent alomost 2 months in Jail. first of all, Jail is not good, but if you have to clear your debts then i think its better to go to jail then paying money. different police stations have dirty situation. you wont have a good or clean mattress and blanket. they will provide 3 time food free. you have to buy bath items. 

if you have hearing in court then they will take you to court and the next day or same day will be transferred to main Jail. that is clean and big. you will sleep on bunker beds. but you have to pay 5-7dhs every week for cleaning. otherwise you have to clean whole jail!!!

people call it five star jail. 

But still I will say if the cage is made of gold its still cage and there is nothing like freedom.

Like the other peeps, I do have a credit card and a loan payment to be done in Dubai. And right now , I am in another country. But I would like to repay my dues and get back to Dubai and i know that I have a police case against me, Kindly tell me the procedure of going ahead. Do I pay the bank back and tell them to give me the clearance from the police? Do I have to produce any paper at the airport?
