Anything new to report since your last post from July of 2011?
We were one of those 'customers' who was contacted by the NJ AG with a complaint form. Completed that process immediately and have never heard anything back. If nothing else, do you know how we can contact them to check on the status of their part in this?

I went to them they had no problem taking my money. Yes the calls stopped. Then I was served at work for garnishment. When I called to complain I was told to get a lawyer. I called back for a supervisor who was very sorry for what had happened, took that account off my debt list and lowered my monthly payment. When I was served again at work for a second garnishment I CANCELLED.. This company took over 3700.00 from me and did nothing!!! I never received any money back from them. I also heard them advertised on KFI recommended by the on air person at the time. Needless to say I still have my wages garnished.

I received a letter on September of 2011 from Prudential Law Group stating that they will be able to help me for a loan modification.. I talked to my husband about it and we were so desperate to get our mortgage lower. So I called the phone number 1-866-748-9506 and spoke to name James Harrison and he sounded so real to me. Me and my husband talked about it and we decided to go through the process. Then next person that we talked to Jim Ramsdale(aka MANAGER) and he said to my husband that we can lower it for to $978.00 dollars a month and he said as soon we received the payment of $4200 and they will start processing and also all documents needed for loan modification...then spoke to Gloria the money handler and told me that right three checks for $1400 each and post date. I did do it and they keep in touch with us letting us know rec'd payment and will start processing. So many people that we talked to Michael Anthony, Dennis Serna, and Nate Rhodes. So were told that by February of 2012 will get it done....Dennis Serna told us that had a meeting with our lender the CITIMORTGAGE and it is looking good not to worry. I had a bad feeling but it was too late checks been cashed. Heres come middle of January got a call from Nate Rhodes stating that we didn't get approved no reason on why..Nate Rhodes said that will talk to his manager to call me explained things....So I called Nate Rhodes because we were told also that we can do cash for keys if we lost the house meaning do not destroy the house will get money from the mortgage company and have 30 days to move out and he said going to a meeting will call me back for more details and he never called me back and keep calling no answer or the the woman in the front desk keep saying he is at the meeting again...My husband got a call back from Jim Ramsdale (Manager) and he didnt even know that we didn't get approved how twisted is that a manager didn't know on what is going on...he told my husband that he would call back for more details and never called us back..none all of the people that we talk to it was just answering machine..Nice Dennis Serna finally answer the phone and he told me can't check the status because all of the system was down and asked for how long and said to check again later...said ok.. two hours later called back no answer..By the way the name of the company now when you call is Prudent Law Group not Prudential Law Group anymore....

MJ,

Congratulations on you progress paying down your debt. In spite of your problems you sound like the kind of person who is going to survive and succeed.

I'm really not qualified to address your business concerns, but I can tell you that millions of Americans are unbanked and function. For many, the key is the prepaid "credit" card. WalMart may be the largest "bank" in America because consumers can cash checks, purchase cards with the Visa logo that can be used for virtually all transactions, and transfer money and pay bills. Other stores also offer these services.

Of course there are costs for all these transactions but studies have indicated for some consumers it is less costly to "bank" in this manner than to open actual accounts. And if you can't maintain an account it is probably your best option.

I would imagine that that there are record-keeping requirements for businesses that complicate things so you might want to discuss that aspect with a CPA.

Good Luck!

PW,

Payday loans are evil and insidious and I am sorry you got caught up in that web. Since they are on-line you might explore the possibility that the terms of your loans violated the laws in your state. Many states restrict payday lending and fear of action from an attorney general can be enough to get some lenders to accept settlements. Contact the consumer protection office in your state to see if you might get help.

You certainly can offer to settle for the amount owed less fees and the lender may accept. You do not need to pay a settlement company to make an offer. It never hurts to try to settle but I would not simply send send a check and announce that you are done paying. And you may find that closing your checking account has some ramifications too.

Good Luck!

I'm not sure you can make the 3rd mortgage go away. If you live in a non-recourse state you can make the the 1st go away by giving up the house and if the 2nd was used to purchase the house you might make it go away by giving up the house, If you live in a recourse state you need to talk to an attorney.

The 3rd is a different deal. It is likely a recourse loan meaning you likely owe it even if you give up the house and the lender can probably stop a short sale if they want to. The 3rd is certainly secured and the house is probably tied up. And, $88k is a lot to just write-off.

If your 3rd has been sold to a collection agency they probably paid a discounted fee and might be willing to settle for less than the $88k owed but I would be very surprised to see the debt just go away.

So the bad news is the house is more likely to go away than the 3rd mortgage.

Good Luck!

Good Luck!

I am appalled by this situation!
As matter of practice, this should be "automatically" reviewed and resolved during the settlement period when debts and assets are divided.
Unless the soon to be ex WANTS to remain a co-signer, the student should be forced to refinance these loans leaving the "co-signer" free of further obligation, much the same way the family home is settled with a re-fi and quit claim deed.
So not only do we have ZERO consumer protections for student loans, they can also continue to haunt us after divorce as this story points out.

Robby...I don't know if you're up for this type of battle, but it couldn't hurt to get all your facts together and start an online petition targeted at whoever it is that currently holds the loan (as Steve mentioned, you can get this information from the National Student Loan Data System).
There area a variety of sites you can use for this; change.org, signon.org, and so on.

You can also reach out to a lawyer specializing in student loans to see what they may know about this. Here are a couple to get you started; Joshua Cohen at http://thestudentloanlawyer.com or Adam Minsky at http://minsky-law.com/

I wish you luck with this, please keep us posted!

It's weird. I have called all these class action law firms to see if they would take a case like ours and NO ONE seems to be interested in it and this is a very, very legitimate case! I hear about other cases from people who have been ripped off for way less and they get their case blasted on the news - what does it take for people like us to be heard??? Seriously!! Do we have to hold someone hostage or something??

Bro Steve!

Come on now you put your self on blast!

Just because your living in your own little
reality where there is no reality you stumbled
on the next greatest thing!

If you look closely all the people that
signup are asked what they are into
for example: cooking, automotive,
travel male or female and...

...with only 30% of emails ever get
read thats compared to over 99%
of text messages get read with in
minutes. Your going to see a BOOM
of people and advertisers are literally
waiting until cashtexts gets to the 100,000
opt in mark. We believe what comes before
the chicken or the egg obviously we need the
people first to opt in! Which Means they want it
they need it and if someone wakes up one
morning and they don't receive texts they are
almost going to feel naked with out them.

Its going to become part of our lives and
the way we live. Receiving deal from pizza
shops your local sporting store you name.

You can take a centralized area of zip codes
and blast that out this is called laser targeting
your customers. Get with reality start listening
to some tony Robbins and get your head our
of the gutter and i might let you on my team!

I need you to call me before you join my team.
One thing that you need to know is there is a
big group of people all meeting at the corporate
office at cashtexts corporate office and more
and more are coming and multiplying being
trained the right way and they are going out
and getting corporate account and things are
moving so fast!

So much activity is going on in my business
i have never seen anything like this! Absolutely
mind blowing.

Until than,

Scott R.

So much blame placed on CESI, but Careone doesn't take any responsibility for there actions. No one has mentioned care one selling CESI accounts to Persels & Associates. If CESI wants to blow this lawsuit out of the courts, they should review those accounts transferred to Persels or find one of the many employees abandoning ship over at care one.

Please pardon my skepticism, but there have probably been at least half a dozen such attempts to "automate" the debt relief process, if not more, and so far none of the former entrants seem to have "changed the debt relief landscape" to any significant degree. So it will be interesting to see whether this latest effort manages to achieve any real traction with consumers.

Also, I can't resist asking how a firm that just launched in 2012 can claim to be "the" leading online debt relief and financial education service? :-)

Hi Cindy,
What you and your husband are experiencing is unfortunately not so unusual today. I understand that you are nervous and feel unsure of your next steps. Being on the receiving end of legal action by one of your creditors is really scary.

My recommendation is that you explore all of your options. Your first step should be to find a few reputable providers, check with your local Better Business Bureau (BBB) to help identify reputable debt relief providers. I would then go to their websites and familiarize yourself with the various services offered.

CareOne Debt Relief Services features a huge user community where you can see firsthand what their actual customers are saying about their services, both debt management and debt settlement. Lastly, call and speak to somebody and ask as many questions about the plans, the payments, and how the services work with your creditors.

I wish you and your husband the best of luck

I have found LinkedIn profiles of several employees at this company. Some may no longer work there, others may still be active. Any attorney who defends these scam artists way of doing business is "A company that is of highly questionable ethics".
Looks like you are the one with the uncanny way of changing this entire article to poke at Damon.

Nicholas,

I wish I had some good news, but you are not in a good place. It is extremely difficult to discharge student loan debt through bankruptcy. Short of a life-threatening disease or accident it isn't likely. Your lender has no obligation to be kind or helpful. A private lender is less likely to be patient than the government.

Most importantly, as co-signers your parents are on the hook for this debt. If you do not make the payments I suspect they will be extracting the money from your parents fairly soon. And the lender is likely adding penalties, interest and fees each month you do not make the full payment so the amount of the debt is likely growing. You need to talk with your parents and they need to understand that you owe $800 but soon it may be $900 a month and if you don't pay, your parents may end up paying $1,000 a month or more down the road.

I understand your issue, but the fact is, if you borrow $100,000 for education you must earn far more than $21,000 per year or you will be in serious trouble and you are. If you were mislead by the school you attended you might consider legal action against the school.

Good Luck!

I have been with this program for 2 1/2 years. I have gone though 3 reps. I paid MOST of my debt out of pocket. I put 12 cards in the program and now have 3 left to pay. Plenty of money in escrow now, and can't get anyone to pay anything. They rarely return calls or emails. I have a feeling that I will never see my escrow. Is there anyone out there that knows what we can do to fight this company? I 'm still paying them $600 a month because I'm afraid of getting a penatly charges.

Any bank account that has your name on it that has non exempt funds placed in it is at risk.
CAN they come and take stuff from you? Yes.
WILL they come and take stuff? I don't know. That kind of thing does not occur much, but you should know it is a possibility.

Here is a quote from a bankruptcy attorney in Utah:
"Though debtor’s exemptions are very limited, bankruptcy trustees seldom take household items from debtors because household goods have so little resale value that they are not often worth the trustee’s time to try to sell them. On the other hand, creditors’ attorneys outside of
bankruptcy, like to attach and have execution sales of non-exempt household items because of the extreme emotional leverage it gives them
in pressuring debtors to pay a judgment for fear of loss of possessions that are very important to the debtor."

Thanks Rosi.

The details you gave reminded me of a thread I think you started on this web site in early January. I found that thread and read through it as well.

If you have not already connected with a different attorney or two for a second opinion, please do.

The details you provide suggest you should qualify for chapter 7 unless I am just missing something.

I do not know the following attorney in MA, but I do know Andy Faria in MA who recommended another reader contact this attorney, and I trust Andy's judgement.

Here is what Andy wrote to another reader on a different thread:
"Try Attny Tom Benner from the Law Offices of Smellof & Benner. They
have offices throughout the state and consultattions are always free.
I'm not sure if he would be able to work pro-bono, but I do know he is
always flexible and understanding.
He's a great guy and I'm sure you will agree if you wind up meeting with him. His direct # 781-706-3228.
Good luck,
Andy"

You can't beat the price of that consult and a second opinion will not hurt anything.

The story. We were living in way too much cc debt, my husband travelled for work and I quit my job to travel with him for 2 years. We had some savings, and had been paying more than the minimum on credit cards, actually we paid 800 a week to cc at that time, which is what he was getting per diem. We used the cards to pay hotel, etc, then used per diem to pay them. There were 5 major cards.

Then he got laid off Jan 2010.

We stopped paying all but the mortgage and car in January 2010, thinking
we'd pick it up when work resumed. That didn't happen, and
unemployment, when it finally kicked in, with our savings, barely
covered our basic food/heat and these costs.

We talked about filing July 2010, but because of payments to a family member were advised to wait a year or they could be sued for preferential payment. Also we did not want to walk away from the house.

My husband went back to work for 2 months (April to June 2011) for the same company, then he got laid off again, resulting in no income for a couple months, then 200 less per week in unemployment when that was straightened out. We had no more savings, and we stopped paying the mortgage in June 2011 so we are now behind 11k on our mortgage.

August 2011 talked to same attorney, was told to apply for food stamps and medicaid, and call local legal aid. We didn't qualify for any of the programs.

Unemployment started up in October. Thank God for family. We paid/made almost nothing this past summer. We also contacted the attorney and gave him retainer for Ch7. Were advised we probably wouldn't have any problems. They way I understood it, if we could get back to work it would show we could make our mortgage/car payments if we could get out from under everything else, and start over.

Dec 30 we were told that if want to keep the house, we'd have to file Ch13.

My husband went back to work again Jan 1 2012, and this job ends in a couple weeks, not sure if they have more work for him or not. Can't get private insurance because he qualifies on 3/1/11, If they have work... We did finally make a mortgage payment, in January, they cashed it and then sent us an intent to foreclose document. We live in MA.

The debts (totalling approx 60k) are mostly credit card companies Unpaid for over a year. Two of the credit cards have liens on our home, this is our fault as we didn't go to the court dates. Depression and outright denial made it easier. The current judgements are May 2011 for 17,500 (credit card) with a date in April 2012 for a civil review of nonpayment and Sept 2010 for 10,059 (credit card) There are other amounts smaller, less than 2k each and several that are old (2004 and earlier) that were either settled or past SOL, even though they keep pretending they're current. I'm amazed at what collectors try! I had gone through all our old debts in 2004, made settlements and paid them off. The car will be paid off in March, it's actually mostly late fees owed, so we are proud owners of 2 cars with over 160k miles each.

The pre filing counseling was done Jan 16, 2011. I guess I'm just not asking the right questions, If husband keeps working, this plan would have us pay $700 month to trustee, and put about 15k in the bank yearly for I don't know how many years, to be paid to the trustee, "if they'll go for it"

I'm so lost, the budget I initially gave attorney was with little or no income, so now after him working 1 month it looks like we have 2k per month in disposable income! I'm re-doing that budget, but don't know what constitutes "reasonable' as we've obviously been living frugally, there are no deductions for insurance because of the waiting period, and our car payments will be over.

In the meantime I've started a small business in direct sales with a very small ($50) investment in which I see a real future building as I've invested tons of time and education and have extreme support from my upline, and I love doing it, something I can't really say for any other jobs I've had. I have been spending money on marketing/advertising/samples in the past month.

I'm 55, and my husband is 49. We have retirement accounts, current 401k $13k, his IRA from a former employer $10k, and 2 Roth IRAs with 12k total.

We stopped paying all but the mortgage and car in January 2010, thinking
we’d pick it up when work resumed. That didn’t happen, and
unemployment, when it finally kicked in, with our savings, barely
covered our basic food/heat and these costs.

We didn’t qualify for any of the programs.

Unemployment started up in October. Thank God for family. We paid/made almost nothing this past summer. We also contacted the attorney and gave him retainer for Ch7. Were advised we probably wouldn’t have any problems. They way I understood it, if we could get back to work it would show we could make our mortgage/car payments if we could get out from under everything else, and start over.

Dec 30 we were told that if want to keep the house, we’d have to file Ch13.

My husband went back to work again Jan 1 2012, and this job ends in a couple weeks, not sure if they have more work for him or not. Can’t get private insurance because he qualifies on 3/1/11, If they have work… We did finally make a mortgage payment, in January, they cashed it and then sent us an intent to foreclose document. We live in MA.

The debts (totalling approx 60k) are mostly credit card companies Unpaid for over a year. Two of the credit cards have liens on our home, this is our fault as we didn’t go to the court dates. Depression and outright denial made it easier. The current judgements are May 2011 for 17,500 (credit card) with a date in April 2012 for a civil review of nonpayment and Sept 2010 for 10,059 (credit card) There are other amounts smaller, less than 2k each and several that are old (2004 and earlier) that were either settled or past SOL, even though they keep pretending they’re current. I’m amazed at what collectors try! I had gone through all our old debts in 2004, made settlements and paid them off. The car will be paid off in March, it’s actually mostly late fees owed, so we are proud owners of 2 cars with over 160k miles each.
