Diana,

I can understand your idea of wanting to pay the old debts off, but I would ask you can you do it?

You mentioned you are ineligible for a DMP due to not having steady work and also your student loans are in unemployment deferment.

If you are not working and earning a regular pay check, how can you maintain any payment arrangements that may be put into place?

If you cannot maintain any arrangements, then bankruptcy does begin to look like a strong option.

You may wish to consult a bankruptcy attorney in your area just to get more information on bankruptcy and how it would affect you.

Also, in 30 months when the student loans come due, you will need to begin paying them back, which unless you could clear all the other debts by that time, will impact what you can afford to pay as well.

Let me know your thoughts on this.

Jon

I am an woman in my 50's who started a career late. I graduated with a BS 5 yrs. ago so I have 46,000 in student debt, but, also a $4,000 judgment and $11,000 more from credit cards.  I believe I can still pay the $4,000 before going back to school to get my Masters as I may, but,, worry about the old charged off debt, and the $11,000 coming back to haunt me.  I really DONT want to do a bankruptcy….but everyone is telling me I should.  My student loan still has 30 mos/. of deferment available and is currently in unemployment deferment.

Is there any reason why I shouldn't TRY to pay the old CC debt off on my own (can't do DMP as work is not permanent yet) then do the bankruptcy (which I already paid for) later?
