OfflineMadeline,
I am sorry to hear of the loss of your father and also your recent issues with your mother.
I have a couple of questions:
Was the Amex account just in your father's name?
How was your father's estate settled when he died?
Who was the person who handled your father's estate or will?
Does Amex know that your father has passed away?
Have you discussed this with an attorney?
I ask as the debt may have gone with him or been passed onto his estate to be paid depending on a few factors.
If he was alone on the debt and died with nothing to pay it, it was only his responsibility and up to Amex to pursue his estate if there was one.
Let me know.

Long time customers of Amex… about 40 years. Dad passed 4 years ago, and we have been making payments on a 16000 debt; got it down to around 9000$ and then started 100$ a month. After missing one month they sent it to Wagner and Hunt, who was willing to go with the same arrangement, and then discuss a settlement possibility. We (mother and i) were in 2 car accidents within a very short time, and missed a few months payments. Next thing we were served by Wagner and Hunt. I spoke to them and said she wasn't well but that I would try to work with them and come up with some money by the end of the month. (Difficult, because I am partially handicapped single mom,not working now, and unemployment is a mess and way behind. Mom is living on social security.) The next day she fell and got a fractured skull and brain hemorrhage. She is home from the hospital and doing a bit better, but just not in any condition to deal with this. She will never work again (she is 70.) She does own a home, which she is barely hanging on to.
Can I use her mental and physical state to gain leverage on my position with them? I did cal last week and told the woman what was going on; haven't heard since. The remaining debt is around 8k. Also, for that amount, and knowingly dealing with a retired, handicapped person, will they really go all the way with this suit?
thank you,
madeline
