			<content:encoded><![CDATA[<p>From <a href="http://getoutofdebt.org">How to Get Out of Debt</a></p><p>Well the September foreclosure figures are out from RealtyTrac. And while we can look at the big, really big number and compare it to foreclosures a year ago that does not give a real understanding of the fear and loss experienced by over 81,000 families that month.</p>
<p>Maybe there is some hope headed down the road for homeowners that will soon be heading into trouble. The FDIC (Federal Deposit Insurance Corporation) is making grunting noises to the Senate Banking Committee and the Treasury Department that a way needs to be found to prevent avoidable foreclosures.</p>
<p>Delinquent mortgages, like credit card defaults, do not have to turn into a financial train wreck if lenders would simply evaluate a consumers situation and modify the credit card balance or mortgage terms to fit within the new circumstances.</p>
<p>RIght now homes are being foreclosed on and many are headed into bankruptcy and neither of those situations needed to come to that end with a little cooperation from lenders.</p>
<p>Shelia Bair, the head of the FDIC recently said that &#8220;Loan guarantees could be used as an incentive for servicers to modify loans,&#8221; Bair said. &#8220;Specifically the government could establish standards for loan modifications and provide guarantees for loans meeting those standards.&#8221; That way, she said, &#8220;unaffordable loans could be converted into loans that are sustainable over the long term.&#8221;</p>
<p>That is good news and I hope that it actually happens. </p>

Have you heard the stories that the government wants us to get out and go shopping to stimulate the economy? Remember after 9/11 when President Bush encouraged people to go shopping to get things moving again?</p>
<p>Well I think the patriotic shopping argument may have gone too far now with Discover flying their American flag credit card. (<a href="http://www.cardoffers.com/partners/links/cards/details.asp?id=954&#038;tempid=459652">You can see the card here</a>.) Every time you&#8217;d pull it out you know you were doing your best to help jump start the economy. And what could me more red, white, and blue than a 0% intro APR?</p>
<p>But at a time that people are being encouraged to go shopping and spend, it is the exact wrong thing for people to do when faced with escalating costs, an uncertain job market and foreclosures in every neighborhood. Don&#8217;t believe me about the foreclosures? Take a look at RealtyTrac.</p>
<p>Now if you feel compelled to do your patriotic duty, please be careful. Maybe an American flag cling on your window as you drive by the mall might be a good first step.</p>

<p>I am thinking of getting a VA Loan. I would be buying the house with my boyfriend. I have great credit (780) but his is low, and has 2 foreclosures. I don&#8217;t feel I have enough income to only use mine. I&#8217;m tired of renting and have done it my whole life, I&#8217;m 35. Any advice you could give would be greatly appreciated.</p>
<p>Would our credit balance each other out? Or would the interest rate be really high because of his bad credit and it wouldn&#8217;t matter that mine was good?</p>

			<content:encoded><![CDATA[<p>From <a href="http://getoutofdebt.org">How to Get Out of Debt</a></p><p>The sagging home values are drawing attention to a gaping hole in bankruptcy protection, the ability for U.S. bankruptcy judges to be able to modify the terms of a mortgage to keep people in their homes that want to pay.</p>
<p>A couple of recent article really caught my eye, &#8220;<a href="http://www.capecodonline.com/apps/pbcs.dll/article?AID=/20081031/NEWS11/81031013">Delahunt: Empower judges to modify mortgages</a>&#8221; and &#8220;<a href="http://www.washingtonpost.com/wp-dyn/content/article/2008/11/27/AR2008112702051.html">A Win-Win Bankruptcy Reform</a>&#8220;.</p>
<p>Bankruptcy judges have the power to change the term of loans for vacation retreats, business and car loans, but no authority to keep you in your home. Silly.</p>
<p>Homeowners facing trouble today or headed to foreclosure will often file bankruptcy to stop the foreclosure on their home. But that won&#8217;t save the home if you can&#8217;t afford the mortgage.</p>
<blockquote><p>Under existing law, bankruptcy courts cannot modify the terms of home mortgages. To keep her home, this debtor needed to demonstrate sufficient income not only to make her ongoing payments at 14 percent but also to cover, during her five-year repayment plan, the payments she had defaulted on. Her proposed plan was clearly not feasible based on her salary, so I had no choice but to lift the stay and allow the foreclosure to continue.</p></blockquote>
<p>However, homeowners could easily be allowed to remain in their homes if the loans were modified either in length or to return the interest rates charged back to a fair and reasonable amount.</p>
<p>When mass foreclosures occur, as they are now, nobody wins. The homeowner, banks and investors win if they can keep the proud and emotionally attached homeowner in the property, making payments, and properly caring for the home. This allows neighborhoods to flourish that would otherwise have vacant and unkempt bank REO homes just sitting there.</p>
<p>If we can&#8217;t give bankruptcy judges the authority to modify these loans in specific situations and under specific guidance then who can we trust to do the right thing, lenders?</p>
<p>This gap in bankruptcy authority seems to be perpetuated because the mortgage industry feels it would be detrimental to the mortgage industry but I have to agree with Judge Leonard when he writes:</p>
<blockquote><p>No one has been able to explain to me why it is not better for mortgage holders to get a fair return of principal back, albeit at a lower interest rate, than to take a lump sum through foreclosure that is probably much less than the value of the note.</p></blockquote>
<p>It does not make sense.</p>
<p>Not allowing bankruptcy judges to have authority to modify mortgage terms only tosses people out on the street. People who will eventually get new mortgages when the economy improves.</p>
<p>It seems that the costs passed on to us, the consumers are not because mortgage defaults, but because logic does not prevail. </p>

<p>Ocwen estimates the company&#8217;s foreclosures result in an average loss of $122,000, or 59% of the loan amount. The figure has more than doubled since last year, causing Ocwen to look harder at lowering principal payments.</p>
<p>Early trends are encouraging. A recent study by Credit Suisse found that roughly 12% of Ocwen borrowers who had their loan balances reduced in April were at least 60 days past due five months later. In comparison, the default rate on less-aggressive loan modifications was 22% or more.</p></blockquote>

			<content:encoded><![CDATA[<p>From <a href="http://getoutofdebt.org">How to Get Out of Debt</a></p><p>Foreclosures are increasing nationwide, and so are scams that promise to “rescue” homeowners from foreclosure.  What these scams do is take your money, ruin your credit record, and wipe out any equity you have in your home.  </p>
<p>Foreclosure con artists take advantage of people who have fallen behind on their mortgages and face foreclosure.  Con artists know that people in these situations are vulnerable and likely to be desperate.  Potential victims are easy to find: mortgage lenders publish notices before foreclosing on homes.  After reading such notices, con artists approach their targets in person, by mail, over the telephone, or by e-mail.  They advertise their services on Web sites or publications.  They often refer to themselves with titles that sound official, such as “foreclosure consultant” or “mortgage consultant,” and market themselves as a “foreclosure service” or “foreclosure rescue agency.”<br />
Your mortgage lender – or any legitimate financial counselor – can help you find real options to avoid foreclosure.  If someone offers to negotiate with your lender and offers to arrange to stop or delay foreclosure for a fee, carefully check his or her credentials, reputation, and experience.  To protect yourself, follow the recommendations contained in this Consumer Advisory.  </p>
<p><strong>WATCH OUT FOR FORECLOSURE RESCUE SCAMS</strong></p>
<ul>
<li><strong>Lease-Back or Repurchase Scams</strong> – Be very suspicious if someone offers to pay your mortgage and rent your home back to you.  This scheme often involves signing the deed to your home over to the con artist.  The con artist may promise to sell your home back to you, but this may be very difficult, if not impossible, under the terms of the contract.
<p>Signing over the deed gives the con artist the power to evict you, raise your rent, sell the house, or steal the equity you have in your home.  You will still be responsible for your mortgage, so if the con artist stops paying it, your lender would have the right to foreclose on your home, and the foreclosure and any other problems would go on your credit record.</p>
<li><strong>Refinance Fraud</strong> – Look out for people posing as mortgage brokers or lenders and offering to refinance your loan so you can afford the payments.  Con artists may trick you into signing over the ownership of your home by saying that you are signing documents for a new loan.<br />
Signing over the deed to your home exposes you to the dangers described above.  Even if you are a victim of fraud, you could still lose your home. </p>
<li><strong>Bankruptcy Schemes</strong> – Several scams attempt to abuse the bankruptcy laws.  For example, a con artist may ask you to give a partial interest in your home to one or more persons.  Each holder of a partial interest can then file bankruptcy, one after another.  The bankruptcy court will issue a “stay” order each time to stop foreclosure temporarily.  However, the stay does not excuse you from making payments or from repaying the full amount of your loan.  In another kind of scam, a con artist may offer to obtain refinancing or negotiate a payment plan with your lender.  If you may make payments to the con artist, he or she may keep the money rather than pay the lender on your behalf.  The con artist may even file a bankruptcy case in your name, without your knowledge, as a part of the scam.
<p>Bankruptcy laws provide important protections to consumers.  Scams can only temporarily delay foreclosure, and they may keep you from using bankruptcy laws legitimately to address your financial problems.  Signing over ownership of your home, or even partial ownership, can result in serious financial harm.</ul>
<p><strong>HOW TO PROTECT YOURSELF FROM SCAMS</strong></p>
<ul>
<li><strong>Know what you are signing</strong>.  Read and understand every document you sign.  If a document is too complex, seek advice from a lawyer or an approved, trusted financial counselor.  Never sign documents with blank spaces that can be filled in later.  Never sign a document that contains errors or false statements, even if someone promises to correct them later.
<li><strong>Get promises in writing</strong>.  Oral promises and agreements relating to your home are usually not legally binding.  Protect your rights with a written document or contract signed by the person making the promise.  Keep copies of all contracts you sign.
<li><strong>Make your mortgage payments directly to your lender or the mortgage servicer</strong>.  Do not trust anyone else to make mortgage payments for you.
<li><strong>Be very careful about signing over your deed</strong>.  Foreclosure scams often require you to sign over ownership of your home to a con artist or another third party.  Never sign over your deed without getting the advice of your own lawyer, financial advisor, or other independent person that you know you can trust.  Understand the terms of the deal you are making.  By signing over your deed, you lose your rights to your home and any equity built up in the home.
<li><strong>Report suspicious activity to the Federal Trade Commission and to your state and local consumer protection agencies</strong>.  Reporting con artists and suspicious schemes helps prevent others from becoming victims.
</ul>
<p><strong>HOW TO FIND LEGITIMATE HELP FOR YOUR FINANCIAL PROBLEMS</strong></p>
<p>Contact your mortgage lender or mortgage servicer as soon as you think you are unable to make your mortgage payment.  Lenders are often in the best position to help, especially if you are current on your loan or not seriously late on your payments.  Your mortgage lender or mortgage servicer may be able to identify options to help you bring the loan current or to modify your loan. <p><strong>Idea 1</strong></p>
<p>Lower the price of consuming. State governments could suspend sales taxes, with the federal government picking up the tab. The feds, under this plan, would pay states 5 percent of the 2007 consumption amount of their residents.</p>
<p><strong>Idea 2</strong></p>
<p>Homeowners could automatically renegotiate mortgage terms when prices in their area fall more than 20 percent. Lenders must participate. They would have to reduce the face value of the mortgage by the amount houses in the area fall in value, according to an index of prices in the given Zip code.</p>
<p><strong>Idea 3</strong></p>
<p>Government has spent billions of dollars trying to avoid foreclosures but has not managed to encourage home purchases. &#8220;There are many, many potential buyers out there, but they are afraid. Therefore it is important that we initiate some programs to bring the demand curve up.&#8221;</p>
<p><strong>Idea 4</strong></p>
<p>Encourage growth through consumer spending. By suspending worker Social Security contributions the government would effectively boost employees&#8217; take-home pay and pump billions of dollars each week into the economy. Workers would feel like they had a better handle on their household budgets, helping boost confidence in the economy. Consumers could spend money on products or services but also pay down debt.</p>

<p>The slumping economy has prodded many merchants for the first time in years to promote this form of installment buying, which dates from the Great Depression. Anecdotal evidence suggests layaway is gaining traction with tapped-out consumers.</p>
<p>Wal-Mart stopped taking layaway orders in 2006, citing an era of easy credit and the headaches of handling the goods. Well, guess what? Consumer credit is getting tighter at a time when rising joblessness, foreclosures and prices make it harder to pay off credit card debt.</p>
<p>&#8220;The American consumer didn&#8217;t vote to end layaway, only retailers,&#8221; said Michael Bilello, vice president of business development for eLayway.com, a three-year-old Tallahassee startup that handles layaway for 1,000 retailers and wants to be the PayPal of a revived industry. &#8220;People this year are wising up to their parents&#8217; advice: If you can&#8217;t pay in full, try layaway.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>From <a href="http://getoutofdebt.org">How to Get Out of Debt</a></p><p>I just wrote an article about the really high foreclosure rates as reported by RealtyTrac. That really got me thinking about foreclosures in my area so I went to RealtyTrac to find my local foreclosures, and there were a lot more than even I expected, and the economy around me isn&#8217;t bad!</p>
<p>If you want to find a local foreclosure around you just use the RealtyTrac link and either plug in your zip code or your city and state. I think you&#8217;ll be as shocked as I was. </p>
<p>I even plugged in 90210 (Beverly Hills) and there were 1,040 either in pre-foreclosure, at auction, or bank owned. The bank owned group was 399 properties alone. These are homes where the bank was the highest bidder at auction and is now sitting and holding this property.</p>
<p>I&#8217;m sure there are plenty of foreclosure investors that are just sitting on the fences right now waiting for the real estate market to reach bottom and then snatch up loads of foreclosures. </p>
<p>It is interesting that in a horrible market with more than 80,000 homes a month being sold at auction that it spells opportunity and profit for the foreclosure specialists.</p>
<p>I bet the banks are going to cut some really good foreclosure sales deals to unload all these homes sitting on their books. Besides, some communities are requiring the banks to keep the properties in good shape and keep the lawns mowed. That&#8217;s just more expense to the bank for a non-income producing property it is having to hold.</p>

<p>Our house payment is killing us. Is there a source for grants for people in tough situations</p>
<p>We have to sell our house but cannot drop the price. Are there sources of grants available.</p>

<p>Dear David,</p>
<p>The only time I have seen any sort of money really available in a situation like this has been for union members, check with your trade union if you belong to one, or for current employees of large companies with support services like the <a href="http://clara.abbott.com/us/">Clara Abbott Foundation</a>, an awesome resource for Abbott employees.</p>
<p>From what you&#8217;ve shared it sounds like you have fallen into the headlines on the nightly news and become subject of something much larger than you as an individual.</p>
<p>Your situation is typical with 10,000 foreclosures a day happening as I write this. Those 10,000 homes belong to families just like yours. They belong to people who have found themselves in impossible situations without seemingly any way out.</p>
<p>I would encourage you to contact your mortgage company and explain to them what has happened. Who knows, maybe you&#8217;ll be one of the one in ten that actually gets meaningful help from the mortgage company and get your loan modified so that you can actually afford it. </p>
<p>You don&#8217;t need to worry about being honest with them about your situation, they will discover soon enough that your ship is sinking fast.</p>
<p>The three most realistic solutions here are:</p>
<ol>
<li><a href="http://getoutofdebt.org/1018/americas-job-bank-find-a-job-now"><strong>Increase Income</strong></a> &#8211; I know, easier said than done. But <a href="http://getoutofdebt.org/1018/americas-job-bank-find-a-job-now">use the job bank page I put together</a>. It is a free service that helps you to identify open jobs in any state. Income now will bridge that gap.
<li><a href="https://www.leadpile.com/form.js?site=GetOutOfDebt=5Nx9fl&#038;style=bankruptcy/250x250-6&#038;types=32&#038;links=&#038;view_form=1"><strong>Bankruptcy</strong></a> &#8211; Bankruptcy won&#8217;t make your home payment for you but it will allow you to eliminate your debt and obligations for a home that you simply may not be able to afford right now. Finding a bankruptcy attorney and getting a free bankruptcy review is always a smart thing to do.
<li><strong>Pay Only What You Can Afford On The Mortgage Right Now</strong> &#8211; I know, you&#8217;re probably saying I&#8217;m crazy for saying that but read on. If there is not enough money coming in to make a full mortgage payment you can always send in what you can afford to pay. Now that partial payment will put you behind but at least by sending in what you can afford now it will reduce the amount you&#8217;ll have to catch up once you get another job.
<p>The partial payment will put you in default and hurt your credit report and credit score but as long as you are open, honest, and not a jerk with your lender then your past due mortgage will begin to flow through the normal process for delinquent mortgages. That will buy you some time to find a new job.</p>
<p>Once you are behind on the mortgage then the lender may be more willing to talk about solutions for your mortgage situation. As long as you are current on your loan, lenders don&#8217;t want to tell you what they can do for you, they want you to make the regular loan payment.</p>
<p>With the number of past due mortgages flooding the lenders, yours will just be another in the stack. They will not take your home this month or next month or maybe for many months.</p>
<p>Use that time to make a job of getting a job and spend eight hours a day looking. Try temporary companies, <a href="http://getoutofdebt.org/1018/americas-job-bank-find-a-job-now">the job board link I gave you</a> or one of the other many places online.</p>
<p>You can keep your spirits up to face the hard task of looking for a job if you draw a line in the sand and agree to evaluate your situation again in say 60 days. Until then, pay what you can really afford, don&#8217;t overpay, on the mortgage and hunt, hunt, hunt for that new job with optimism and hope.</p>
<p>While the economic conditions sound dire in the news, the unemployment rate is still relatively low and jobs can be found.</ol>
