<p>I wanted to ask you what my options are concerning my credit card and government student loan debt, as it seems that everyone has special interests and they are not primarily interested in helping you first when it comes to debt relief.</p>
<p>When I went to college in 2003 right out of high school I was a full ride student.  I had Bright Futures and various grants and awards from Florida State University.  However, I did not prioritize my grades over other areas of my life and as a result was academically ineligible for the scholarships, grants and awards that helped me afford college.  </p>
<p>My fraternity I pledged had a credit card fundraiser where we were to sign students up on campus for accounts, and I signed for a few to meet a quota.   I started borrowing Stafford Loans and using the cards and racked up credit card debt.  I also took on jobs to start trying to afford college, but I could not maintain my grades and work at the same time, and I was academically dismissed.  I rapidly fell into debt over the next several years.  As I tried to work and go to school and make the minimum payments on the cards,  I became stressed, depressed and desolate over my situation, and to cope I simply tried to pretend they didn&#8217;t exist.</p>
<p>I am 26 now, about to turn 27 in March.  I am trying to enlist in the Air Force and change my life around.  I have $18k in credit card debt and $26k in government student loans, I confirmed this through all three credit reports.  I have enrolled in a Debt Management program with Care One and am doing research on what my options are with paying back my student loans with the Department of Education.  I have made payments off and on towards my student loans, but have not been consistent.  They are being held by Direct Student Loans and Nelnet I believe.</p>
<p>As I mentioned, at this time, I am trying to enlist in the Air Force and be eligible for a Top Secret Clearance.  Unfortunately, my debt is a glaring liability and I will need to get a FED (Financial Eligibility Determination) waiver and submit a personal statement to be approved to be able to proceed with my enlistment.  This is my only obstacle, I have taken the ASVAB and scored a 99 on the AFQT, the highest possible score.  My MAGE scores were 94, 97, 99 and 95 respectively.  I have a good record and am an outstanding candidate otherwise, barring my financial history.</p>
<p>My questions to you are:</p>
<p>1.  Was the decision to enroll in Care One&#8217;s program a good one?  What other options do I have?  Will I or anyone viewing my credit history see significant changes as a result of my participation in this program?  If so, typically when do they appear?</p>
<p>2.  If I were to receive financial assistance from family members in the amount of roughly $4k, what would be the best way to appropriate those funds to my existing debt?  Would it be better spent on my student loans or the credit card debt?  If I can pay off entire balances with some of the credit card debt, should that be my number one priority?</p>
<p>3.  What are my options as far as paying back government student loans?  They are currently in default status.  I am not aware of the various programs and laws that are out there that may benefit someone in my situation.</p>
<p>4.  Lastly, what can I do to improve my financial situation with the Air Force in regards to enlistment?  I know that there is no quick fix solution, I did not accrue this debt overnight and I will not miraculously fix my financial issues overnight.  But what is the best way to get started and make significant progress?</p>
<p>Any other advice or information you can give would be greatly appreciated.  I clearly do not have a good grasp of personal finances and would be very grateful to hear what you have to say.  I am really hoping I can overcome this and be able to enlist in the Air Force and get on track and turn my life around.  Thank you very much sir.</p>

<p>First off, congratulations on your selecting the Air Force. I&#8217;ve met and helped some really terrific people from the Air Force before.</p>
<p>I&#8217;m going to repost your excellent questions below and respond to the one at a time.</p>
<p><strong>1.  Was the decision to enroll in Care One&#8217;s program a good one?  What other options do I have?  Will I or anyone viewing my credit history see significant changes as a result of my participation in this program?  If so, typically when do they appear?</strong></p>
<p>I&#8217;d like to direct you back to your recruiter and I want you to talk to them openly about your financial situation. Most specifically I&#8217;d like for you to get their opinion on which approach will impact you the least.</p>
<p>The Air Force and other military branches view bankruptcy as a legal process that is necessary in the face of problem debt. This previous Q&#038;A will be relevant for you. <p>What we need here is not the presumed best solution for you but the most informed from which we can make educated decisions and not best guesses.</p>
<p>I&#8217;m not saying the CareOne solution isn&#8217;t the best for you. I&#8217;m saying that we need to evaluate it in light of your goals and your other debt.</p>
<p>I&#8217;m always concerned when people carry debt into military service because I&#8217;ve yet to meet anyone that says they enlisted and get paid too much. Things will be tough enough in your new military endeavor and we don&#8217;t need to add financial pressure on top of it if it isn&#8217;t necessary.</p>

<p>You actually have some incredible opportunities for dealing with the student loans. See <a href="http://getoutofdebt.org/33986/military-student-loan-forgiveness-and-discharge-programs">Military Student Loan Forgiveness and Discharge Programs</a>.</p>
<p>You will need to prioritize your debt repayments first towards your student loans. You want to get those out of default as quickly as you can. That article I just gave you has all the resources you will need to tackle this. I would imagine the Direct Loan consolidation and Income Repayment Program combined are going to be your best bet. Then, once your payments are current you will be eligible for a discharge of your student loans under the Public Service Loan Forgiveness Program after a period of time.</p>
<p><strong>4.  Lastly, what can I do to improve my financial situation with the Air Force in regards to enlistment? <p>Be open with your recruiter. Everything you might be afraid to tell them they can see with a consolidated credit report. In fact I would suggest you get a copy of your consolidated credit report and take a look to make sure their aren&#8217;t any other unresolved financial surprises out there from those bad old days. Let&#8217;s tackle it all at once.</p>
<p>Once we deal with all of this you will need to rebuild your credit, but that&#8217;s actually incredibly simple and I can show you how to do it.</p>
<p>Does that sound like a reasonable plan of attack? If so, go do your homework and let&#8217;s get a plan in motion.</p>

<p>Dear Vic,</p>
<p>The first thing you need to do is get the facts and not assume your security clearance will be damaged by a bankruptcy. In fact the Army says that in the face of overwhelming debt a bankruptcy is a positive step since it is a legal process. </p>
<p>You should read &#8220;<a href="http://getoutofdebt.org/17933/do-i-need-good-credit-to-get-a-top-secret-clearance-alex">Bankruptcy and Your Military Security Clearance</a>.&#8221; The Wites &#038; Kapetan approach is a typical debt settlement strategy where you will have to fall behind on your debts and collectors will be calling, you may be sued as well. </p>
<p>When you fall behind on your debts the collectors may contact your chain of command and this will create a potentially bigger problem for you as well. </p>
<p>The smarter move here is for you to go talk to your security officer and explain the situation. </p>
<p>A reader recently posted this comment on the site that might be helpful.</p>
<blockquote><p>I’ll put my $0.02 in here. As long as your chain of command (both your direct as well as your Security Officer/SSO team), there shouldn’t be a problem. I am currently in the process of filing BK, and after reporting impending judgment cases against me, DSS came back requested a resubmission of my SF86. I filled out the pertinent information (by using the latest info in my credit reports), and the adjudication came back as fine, with the direction to report my filing and discharge as they occur.</p>
<p>With a clearance, honesty is always the best policy. ALWAYS report something that may be an issue, especially finances. In this day and age, DSS/DISCO are willing to let people slide if they’re up front about their issues. <p>You answered a similar question from an active duty member regarding mortgage relief. My situation is as follows. I am active duty, bought a house while on active duty in Colorado Springs. Lived there no problem however I have been ordered to a new post. I have tried to sell the house, but like many, my house is worth less than what it is worth. I have tried to rent it out and wait for the value to rise again. However renting is becoming difficult, no one is willing to pay what I owe for the mortgage. like I mentioned I am at my new duty assignment and I am paying rent here, so essentially I am paying two mortgages and it is getting tough. I am afraid to just let the house go. My credit would suffer and I want to be able to purchase another house in the near future.</p>
<p>What are my options? Open to anything!</p>

<p>Dear Robert,</p>
<p>Air Force?</p>
<p>I&#8217;m afraid your options are limited because of the drop in value and the fact this is non-owner occupied house. The first step would be to contact a local HUD Housing Counselor and see if your specific lender offers any modification programs that make sense for you. </p>
<p>If that does not work out for you then you need to start thinking about a strategic default where you hand the house back to the bank and go bankrupt to discharge your remaining obligation on that first home. </p>
<p>Right about now you are getting concerned about how that will impact your status in the military. In fact your clearance is more likely to suffer because you are maxed out than if you decide to pursue bankruptcy, a legal option, to remedy a situation beyond your control. <p>I&#8217;m in a situation right now where my credit issues are being questioned because of my security clearance. I first made arrangements with the vehicle collection agency to settle the amount of $5080.00. I have made the first payment and received paperwork asking about my credit situation from the Government. In feeling very pressured to do something about my issues, I contacted Mossley Law Firm. I found you blog today and am completely shocked at all the stuff I have read thus far.</p>
<p>Back in 2005 my husband &#038; I bought a home and a new vehicle. Six months later my husband lost his job. I immediately called the finance company to come get the new vehicle. Six months after that, our home was foreclosed on.</p>
<p>When we originally purchased the home for $145,000.00, the loan was in two parts, one for $116,000.00 and one for $29,000.00. The home was sold on the steps of the courthouse for $120,000.00. The larger of the two loans was paid off but not the smaller one. The person that bought the home from the courts turned around and sold it for the same price as we bought it for and the new buyers obtained the same type of loans as we did with a different lender, (it was in two parts).</p>
<p>I was told by the first collection agency and the Title Company that we were not responsible for paying back the second loan, but I have yet to see anything in writing and have come to dead ends.</p>
<p>My questions to you are:<br />
1)      Am I able to back out of this deal with Mossley Law Firm?<br />
2)      What do you think is the right approach to the mortgage issue?</p>

<p>In my opinion I would think that a debt settlement approach would look far worse than a bankruptcy. See this article that discusses <a href="http://getoutofdebt.org/17933/do-i-need-good-credit-to-get-a-top-secret-clearance-alex">bankruptcy and security clearances</a>. </p>
<p>With bankruptcy you are taking a government approved and legal step to resolve your debt situation quickly. With debt settlement your credit report will show an ongoing cycle of delinquent debts and that could leave you appearing more susceptible to being a security risk by bribery.</p>
<p>Ultimately the best advisor on this will be your security officer you work with.</p>
<p>If you are not happy with the firm you are working with then by all means you should cancel your contract. If they have performed no work for you yet then ask for a refund.</p>
<p>If you pursue bankruptcy to deal with the debt then you can wrap any residual liability you may have for the rest of the mortgage debt and your other unmanageable bills. </p>
<p>The forgiven mortgage debt is a problem and others have been sued by banks to recover these funds. Unless you have something as writing as proof then there is no deal.</p>
<p>I&#8217;m not sure I&#8217;m familiar with the Mossley Law Firm but from what you write I assuming they are providing debt settlement services to you. Is that right?</p>

<p>Good for you, you&#8217;re on the right track here. Too much debt and a poor credit score can be more damaging than other solutions like bankruptcy. To quote the Air Force on this:</p>
<blockquote><p>The status of your security clearance can be affected, but it is not automatic. The outcome depends on the circumstances that led up to the bankruptcy and a number of other factors, such as your job performance and relationship with your chain of command. The security section will weigh whether the bankruptcy was caused primarily by an unexpected event, such as medical bills following a serious accident, or by financial irresponsibility. The security section may also consider the recommendations and comments of your chain of command and co-workers. This is an issue that can be argued both ways, so as a practical matter your security clearance probably should not be a significant factor in making your decision about whether to file bankruptcy. The amount of your unpaid debts, by itself, may jeopardize your clearance, even if you don’t file bankruptcy. In that sense, not filing for bankruptcy may make you more of a security risk due to the size of your outstanding debts. By the same token, using a government-approved means of dealing with your debts may actually be viewed as an indication of financial responsibility. Eliminating your debts through bankruptcy may make you less of a security risk.</p></blockquote>
<p>In preparation for dealing with this, if you are having troubles making ends meet or paying your bills I think you should find a local bankruptcy attorney you like and go talk to them. Bankruptcy is the quickest way to reduce your risk in the shortest period of time.</p>
<p>The irony is that as long as you are maxed out or in trouble with your debt your clearance is already at risk. The smart play here would be for you to go and talk to the security officer and discuss the situation after you have met with a bankruptcy attorney and reviewed your situation. Let the security officer know the steps you are going to take, including bankruptcy, to remedy the financial situation and just make sure everyone is on the same page. If you do that then you don&#8217;t have to be stressed out about the clearance.</p>

<p>Hello Steve. I appreciate the advice that you provide us with (=:</p>
<p>I&#8217;m 27 years old, naturalized citizen (born in Russia). Currently in the Army National Guard (Intelligence). My chain of command hasn&#8217;t filed clearance paperwork yet because they&#8217;re waiting for me to resolve my $25000 unsecured credit card debt (including 1 personal loan). I&#8217;ve accumulated this debt over the years due to financial irresponsibility, but the lesson has been learned. Most of my credit card have been canceled by the creditors.</p>
<p>Being a college student with unemployment checks I don&#8217;t see this debt resolved until after 4-5 years from now when I get my Bachelor&#8217;s. I don&#8217;t have a criminal history and am clean off any stains on my record. This debt is eating me up. Every morning I wake up  I carry the burden of my financial debt.</p>
<p>I&#8217;ve been told that I have to have a good credit in order to obtain a Top Secret clearance. I have 2 options and I&#8217;m asking you to tell me your opinion on them.</p>
<p>The first option is to borrow $25000 from a relative and pay the entire debt off. I should mention that it&#8217;s not guaranteed that the relative would lend me so much money.</p>
<p>The second option is to file bankruptcy.</p>
<p>Which of the options do you think would make me look better in the eyes of an investigator?</p>

<p>Here is what the Air Force had to say on this subject.</p>

<p>The best course of action you can take is to ask to speak with the security division that will do your screening. If you look at one of the purposes of a security clearance when looking at debt, to determine who is more at risk of being bribed, then the outstanding debt puts you more at risk. And as the Air Force says<strong> &#8220;Eliminating your debts through bankruptcy may make you less of a security risk.&#8221;</strong> The Army says <strong>&#8220;Likewise, a bankruptcy will not automatically prevent obtaining a security clearance.&#8221;</strong></p>
<p>The Army has also issued advice about this situation. </p>
<blockquote><p>With the nation in the throes of an economic downturn and entering the seventh year of overseas combat, some Soldiers and civilians are worried about their security clearance.</p>
<p>The stress of combat and the rise in foreclosures have some Soldiers wondering if their security clearance will be impacted. </p>
<p>&#8220;All Army personnel should understand that they can obtain counseling services for financial and mental health issues without undue concern of placing their security clearance status in jeopardy,&#8221; said Col. Edward Fish, commander, U.S. Army Central Personnel Security Clearance Facility, known as the CCF.</p>
<p>Army leaders want to ensure Soldiers that the security clearance process is fair, equitable and comprehensive and the Army is taking steps to ensure it remains that way. Leading this effort is the deputy chief of staff, G-2, who is responsible for policy formulation, evaluation, and oversight of intelligence activities for the Department of the Army. This includes policy development and oversight of the security clearance process, to include oversight of the CCF.</p>
<p>The CCF reviews personnel security investigations to grant security clearances for Soldiers, civilian employees and contractor personnel. The CCF uses the national adjudicative guidelines to process security clearance requests. These guidelines outline the standard application of the process, which includes consideration of both favorable and unfavorable information, identify specific concerns, and highlight associated mitigating factors. </p>
<p><strong>A bankruptcy or foreclosure will not automatically prevent one from obtaining or maintaining a security clearance, according to G-2 officials. They explain there are many conditions surrounding financial hardships that often mitigate security concerns. </strong></p>
<p>The guideline for financial considerations focuses primarily on individuals who are financially overextended because they may be at risk of engaging in illegal acts to generate funds. For instance, financial guidelines consider &#8220;the conditions that resulted in the financial problem were largely beyond the person&#8217;s control&#8230;and the individual acted responsibly under the circumstances.&#8221; Adjudicators identify such conditions as mitigating circumstances.</p>
<p>For example, if an individual did not have financial problems in the past, yet was forced into foreclosure because of a permanent change of station, or PCS move, adjudicators would consider this a mitigating circumstance. However, if the individual has a history of not meeting financial obligations and now forecloses on a home, this would display a pattern of financial irresponsibility that cannot be easily mitigated, officials said.</p>
<p><strong>Likewise, a bankruptcy will not automatically prevent obtaining a security clearance. </strong></p>
<p>There are many other conditions surrounding financial hardships that often mitigate security concerns, officials said. About 98 percent of cases received by the CCF which involve financial issues were granted a security clearance. <p>I was thinking of taking your advice and filing for bankruptcy. Of course, I&#8217;d like to apply to buy a house, especially during this time when the housing market is down (Good for us buyers but bad for current owners). Also, I expect to get my clearance background cleared and updated (I had a re-open investigation when I hit my 10-yr mark in 2007 but never completed it before my last job ended) and not sure if bankruptcy would affect my background investigation.</p>
<p>Is it good to file bankruptcy while fully employed? Would it affect my current situation and job, as far as HR and my Employer is concerned? Would my car note be discharged as well (I&#8217;m so behind with my car note but I can&#8217;t afford to catch up with the payments)? How would you suggest starting fresh for someone who is around the corner from being 30 and wanting her own place? Any further thoughts, suggestion and advice is very much appreciated. <p>Dear Miss M,</p>
<p>I can&#8217;t speak specifically about the status of your security clearance but if you are already behind on bills and overextended then that creates a security risk right there.</p>
<p>If you are worried about how bankruptcy may impact your security clearance then I would suggest that you have an open and frank discussion with your security officer at your company. </p>
<p>Around the corner from 30 is still young these days with many having to work into their 80s. The issue about what is best for your company, rather than yourself is a bit misdirected. I understand your concern, you don&#8217;t want to do anything to jeopardize your job but I think you need to get your own house in order first. Unless you tackle your problems head-on they will only continue to hurt you for years and years to come. </p>
<p>My advice is always to be as open as you can. In your case I&#8217;d ask for a confidential conversation with an HR representative and the designated security officer. If they both don&#8217;t have an issue or a problem with you acting responsibly to take care of your debt, don&#8217;t wait.</p>
<p>The irony here is that unless you go bankrupt to tackle the old debts you probably won&#8217;t be in a position to purchase a house in the next several years. But if you do go bankrupt, clear your old debts and get back to saving money again you&#8217;ll be ready to buy a house within a couple of years.</p>

<p>Dear Dear Robert,</p>
<p>As a retired military member with the highest of security clearances, I do understand your concern and dilemma. My drawback is that I have been out of the system for some time and therefore not knowledgeable of current security background checks.  My advice is to check with the Staff Judge Advocate’s office as well as the people handling your security clearance armed with the information I will offer you below on debt reduction/elimination.  Determine from them the best course of action based upon each option and its impact on your clearance.</p>
<p>Your options are fairly limited.  The first thing is contacting the creditor and trying to lower interest.   This may be a mute action but who knows.  It might work. The second option is working through a debt counselor to try to get that interest down and working out a debt management repayment program.  Please check with Better Business Bureau and anyone familiar with a local office before making any commitment to them.   Simply locate a debt counselor in the yellow pages of a nearby major metropolitan area. The third option is debt negotiation.  With this option you or a professional debt negotiator offer less than what you owe…. Say 50%.  That sounds good on the surface but has some drawbacks. Debt negotiation usually requires a lump sum payment and completely destroys your credit.  Additionally any debt forgiven above $600 will be taxable by the IRS as added income.  </p>
<p>Your final option is bankruptcy and unfortunately, this may be one of your few workable options.  You can usually talk to a bankruptcy attorney for a free initial consultation and the attorney can tell you its affect on your personal situation.  You gave no indication as to your assets but I assume they are limited.</p>
<p>But these are your options and you need to weigh each according to your needs, wishes, and desires.  </p>
