Easier Debt Caught in the Debt Relief Marketing Trap – TCPA

Well it looks like Easier Debt of California was just sued over yet another Telephone Consumer Protection Act. This has been a gotcha area that has nailed others.

In the complaint just filed the consumer alleges “Plaintiff alleges that Defendant Easier Debt, LLC (hereinafter “DEBT”) sent automated telephone SMS/Text Messages using equipment prohibited by the TCPA to promote its services without Plaintiff’s prior express written consent.”

“Defendant sent these prohibited TEXTS to Plaintiff on at least the following dates and times:

  • December 15, 2016 01:27 P.M.
  • December 15, 2016 01:50 P.M.
  • December 15, 2016 03:36 P.M.
  • December 16, 2016 03:24 P.M.
  • December 19, 2016 01:48 P.M.
  • December 19, 2016 06:06 P.M.
  • December 20, 2016 03:43 P.M.
  • December 21, 2016 03:16 P.M.” – Source

    But then the complaint includes the texts.
