Consumer Complaint: Upon review of my credit report on XX/XX/XXXX, I found a listing for Account Resolution Services. It is reported as a emergency service related debt, and the company being the debt collector.
I have no history of emergency services need, and have never utilized emergency services. Upon request of validation of this debt, none was sent to me by the company. Reportedly, this was also validated by XXXX XX/XX/XXXX, when I made a request through XXXX after asking them to have the company produce validation. Again, I have not received any documents showing how this account was validated or copies of my signature. I am concerned that this was placed on all three of my credit reports in haste, and I am being charged and penalized for an account I never owned, nor received services for. Not only have I never received services for any emergencies, I have no minor children, and would not be billed for any child I have under the age of XXXX.
Under the Fair Credit Reporting Act, 15 U.S.C. 1681g I have the right to demand that they disclose to me all the documents that they have recorded and retained in your file at the time of this request concerning the accounts that they are reporting in my credit reports. I have asked that they dont respond to my request by saying that these accounts have been verified, as they did with XXXX. I have asked for validation, not verification. I would like copies of the documents that you have in their files related to services they are demanding payment for.
XXXX XXXX Law Dictionary, 6th Edition XX/XX/XXXX defines ” Verification ” as, ” Confirmation or correctness, truth or authenticity, by affidavit, oath or deposition in averments or statements of party. ” What this means is that their company must be willing and able to produce a document that provides the account ( s ) in dispute belong to me, and the information being reported is accurate and they must be able to do this in a court of law. Their failure to provide me with verifiable proof required to post the account is evidence that the account never existed and therefore is proof that they can not properly ” verify ” the account.
If they do not have any documentation in their files to verify the accuracy of these disputed accounts then they need to be deleted immediately as required under Section 611 ( a ) ( 5 ) ( A ) ( i ). By publishing theses inaccurate and unverified items on my credit reports which are distributed to 3rd parties they are damaging my reputation and credit worthiness.
Under the FCRA 15 U.S.C. 1681 ( i ), all unverified accounts must be promptly deleted. Therefore, if you they unable to provide me with a copy of the verifiable proof that they have on file for each of the accounts listed below within 30 days of receipt of then they must have their account removed from my credit reports. It has already been 30 days, and they are already in violation.
