Consumer Complaint: On XXXX/17 I received an alert that a new collection was placed on my account. I called Midwest Recovery Systems. I informed them I never applied for a payday loan and I never received written notification of this debt from them. The customer service representative was rude and informed me that they did not have to give me written notification of anything. I have never done business with Midwest Recovery Systems. I do not have a signed contract with Midwest Recovery Systems. I have a right to demand that Midwest Recovery Systems furnish the signed contract between them and myself. This business did not give me written notice of the debt before placing it on my credit report with all three bureaus. Also this company is not licensed in the state of Tennessee. I would like this unfounded and unvalidated debt removed form my credit report. Per Tennessee Code TFDCPA 62-20-101 ( short title ) and 105 thru 127, Tenn Law emphatically states that ” a collection service can not commence or conduct the business of collecting debts in Tenn without being so licensed and bonded as well as maintaining a ” location manager ” who in turn is required to be licensed and bonded. in the State of Tennessee. UNLICENSED ACTIVITY IN THE STATE OF TENNESSEE POTENTIALLY SUBJECTS THE DEBT COLLECTOR TO CIVIL AND CRIMINAL PROSECUTION
