Consumer Complaint: Trustee Attorney, XXXX XXXX XXXX, XXXX XXXX and their subsidiary and Trustee, XXXX XXXX XXXX XXXX ( XXXX ), misrepresented material facts related to the excess proceeds during the hearing ofXX/XX/XXXX. Specifically, XXXX XXXX XXXX, XXXX XXXX misrepresented the amount of the excess proceeds by omitting the interest paid on the principal balance while they were ” conducting post foreclosure activities ” and only submitting the principal balance to the California Superior Court, case number XXXX. Also, the Trustee and Trustee Attorney misrepresented the amount of the debt and sold the debt associated with the XX/XX/XXXX Bank of America, N. A. Trust Deed and note for almost {$90000.00} less than the amount actually owed at the time of auction. This was done in order to sell the debt because no one buys a debt if they ca n’t turn a profit. If all of the debt was included, it would not have sold at action since the total amount owed would have been equal to the fair market value at the time of auction ( XX/XX/XXXX ).

Currently, Title has not been transferred on the subject property. I am currently homeless and would like to gain possession of my real property and the interest gained or should have been gained on the excess proceeds while the Trustee Attorney was in possession and control of the excess proceeds for at least six months and all other previously requested desired resolutions.
