Consumer Complaint: I have been attempting to pay down my student loans for the past 17 years and have repeatedly had payments in excess of the minimum due either misapplied or not applied at all. For example, a payment on XX/XX/XXXX was lost, after the check was included in a separate envelope attached to my letter asking for the overpayment amount to be applied to the principal balance on my account without advancing the due date. Additionally, I have twice been charged late fees in spite of never having missed a due date. Late fees were charged to my account on XX/XX/XXXX and again on XX/XX/XXXX, in spite of no gaps in my payment history.

Only after very carefully reviewing my account, did I discover in late XX/XX/XXXX that Navient was not applying overpayment amounts correctly. Routinely, in spite of providing two separate letters to Navient with clear instructions, Navient would apply overpayment amounts by advancing the due date. This obviously allows Navient to collect interest on a higher principal balance. This issue was addressed through numerous phone calls and eventually the payments were correctly applied. However, the issue continues. On XX/XX/XXXX, Navient again applied an overpayment incorrectly, again with clear instructions on how to apply the payment correctly.

Unfortunately, I do not have time each month to spend days working to ensure that my payment is applied correctly. I have regrettably resorted, recently, to paying the minimum amount due, so as to avoid the numerous hours and trouble that almost certainly ensues when I attempt to pay toward the principal balance. I would guess that this is precisely what Navient would hope for when making it difficult to pay down student loans. Again, it is not a minor inconvenience ; these practices are a very real impediment to paying off my student loans.
