Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX, NV XXXX XXXX XXXX XX/XX/XXXX CFPB XXXX XXXX XXXX XXXX, IA XXXX Dear CFPB : On XX/XX/XXXX, I received employee instructions for a garnishment/ earnings withholding order from my HR department from an attorney out of California representing XXXX XXXX , XXXX. , much to my surprise. After freaking out about my livelihood being threatened, I called the attorney of record and spoke to XXXX XXXX at XXXX. She said I could modify the amount that is to be taken from my paychecks but I told her this was not my debt, I did not know who the company was nor did I know that the debt/ judgment existed! I have lived in Nevada since XX/XX/XXXX so I was never served any paperwork on this debt nor have proof that the suit was ever published in any newspapers to notify me of the debt.
There are a few issues that need to be raised : 1. I never received debt validation, as I was unaware of this judgment until a few days ago, so I request full debt validation with original application signed etc. 2. This judgment is not on my credit report nor has it ever been so I was unaware of its existence. 3. The judgement /garnishment order was served across state lines without proper domestication of said judgment in Nevada from California , which is illegal. See NRS 17.330-17.400 attached hereto. 4. XXXX XXXX refused to provide debt validation as I kept telling her this was not mine I had not idea what it was. 5. Upon a phone call to the attorney about violating the above laws, they sent a termination of withholding to my HR department. 6. I would like to file as many complaints as there are issues with this situation so that they do not do this illegally to anyone else! I want them to be fined and that they be held accountable to the maximum limit of the law and the judgment to be thrown out! 7. I want monetary compensation for the illegal activity on their part and my rights that they have violated.
