Consumer Complaint: I was never contacted by collection agency, XXXX XXXX XXXX XXXX, or original creditor, XXXX XXXX, about this false debt – {$8000.00}. Original creditor had received a judgment against me on XX/XX/XXXX for {$640.00}. I attempted to get the judgment set aside 3 years later when I discovered original creditor had been paid in full by my housing agency but was sent to mediator instead. In XXXX, I had submitted an application for a new apartment and was shocked when declined due to an outstanding rental debt.

The original creditor had my current address due to the court case I filed in XXXX. The collection agency would have validated my address as well. I was NEVER contacted by either party about this $ XXXX debt because I do not owe it. XXXX XXXX submitted this false debt simply as a way to retaliate against me because I disputed the original judgment. In meditation I let slip that my husband and I were trying to buy a house. XXXX XXXX was forced to report the original judgment as satisfied, thus removing it from my credit file in XX/XX/XXXX.

XXXX XXXX was never awarded a judgment against for {$8000.00}. Arizona Courts will only award landlords actual delinquent rent amounts + damages + attorney/filing fees. Arizona legal statues prohibit landlords from being awarded ” future rent for rentals that may be rented again. ” When I disputed this debt as ” not owed, ” ” never notified, ” & ” illegal ” the credit reporting agencies claimed this debt fell within FCRA criteria and has maintained it on my credit reports thus preventing me being able to rent a place to live, resulting in my homelessness for 1.6 years!
