Consumer Complaint: Wakefield and Associates , Inc. ( XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, TN XXXX ) sent me a letter on XX/XX/XXXX seeking to collect amounts allegedly due to XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, TN XXXX ). I responded to Wakefield ‘s letter onXX/XX/XXXX and disputed the amounts claimed due by explaining that the amounts were either paid to the original creditor, or the amounts were so old that they were barred by the statute of limitations.

Prior to the XX/XX/XXXX notice, I had contacted XXXX XXXX on XX/XX/XXXX, to dispute the amount due because I had received some sort of debt collection letter. I advised XXXX XXXX that the amount was paid, in fact, their system reflected a credit balance of {$190.00} ( it does not today ). I requested that this amount be applied against the balance due. They did not apply it, nor did they refund the money to me.

I was surprised when I came home today ( XX/XX/XXXX ) to find a letter datedXX/XX/XXXX from the Wakefield firm again seeking collection of {$320.00}. This letter detailed the amounts that they were attempting to collect, with the 2 oldest dates reflected as XX/XX/XXXX, and additional service dates in XX/XX/XXXX. They also provided additional documentation that appear to be invoices and a billing summary from XXXX XXXX. However the billing summary does not contain information to reflect the running outstanding balance, nor does it reflect the credit of my check ( # XXXX for {$190.00} ) that was cashed by their office on XX/XX/XXXX.

I will be responding to the most recent Wakefield correspondence by providing documentation supporting my dispute. Since it took them over a year to respond, I am seeking the assistance of the CFPB to eliminate further collection of this debt.
