Consumer Complaint: In XX/XX/XXXX I was deemed XXXX XXXX and was no longer able to work. I held various positions with XXXX XXXX XXXX and I receive a small pension. I applied for Social Security, denied and in the process of appealing the decision.

As a result, my income has been reduced by almost 65 % and I am working with creditors to make arrangements until my social security is approved and I receive what will be a significant ” back-pay ” that will enable me to get caught up with my debt. I am having an issue with one creditor in particular, Wells Fargo Dealer Services, who holds the loan note on my car. I have fallen behind with them but have tried to send as much as a I can whenever I can. I have called several time because they never seem to update my correct contact information or have acknowledged that my wife has power of attorney over my affairs ( I have sent them documents confirming my XXXX and the power of attorney ).

I was finally able to speak with a live person about two hours ago at XXXX. I explained my situation and she stated that she would ” notate the account ”. She also told me that my vehicle can be repossessed at any time unless I pay approximately {$600.00} immediately. I told her that I could not do that however starting in the beginning of XX/XX/XXXX, I can resume my normal payment schedule and any late fees ( which I understand are unavoidable ). She said she had no record of any XXXX, power of attorney, and that if I didn’t pay the {$600.00} in 8 days that the loan would be ” charged off ” and I would probably never be able to get the car back.

I have notified the XXXX Attorney General ‘s office who in turn referred me to this office. All that I am asking for is the following : In addition to not taking the car or charging it off in 8 days : 1. Let me resume my normal payments plus late fees starting XX/XX/XXXX when I get my next pension check.
2. PLEASE communicate with my wife at my REAL phone number ( I will list this later as it says not to include personal information ), not the number they had on record which was false. I am on very powerful medication for XXXX and XXXX issues and I do not have the best memory.
3. Please send me or my wife actual documents that outline what late fees we owe and that we have reached an agreement to resume a regular schedule of full payments as we originally agreed upon. We do not feel comfortable giving out routing numbers and bank account numbers over the phone.

PLEASE NOTE : I reside with my son, as he is in a better position to care for me than my wife is with regard to reminding me about my medication and other assistance. My wife is a XXXX XXXX XXXX patient who must remain in XXXX XXXX State more than I do because her medical team is located there ( XXXX XXXX XXXX XXXX Hospital ).
