Consumer Complaint: On XX/XX/XXXX I received a call from a Pennsylvania number XXXX looking for my husband in regards to a Civil Matter as the woman stated. I let the woman know that I was his wife and asked what a Civil Matter was and she responded with ” He can be taken to court for it ”. I asked her if this had anything to do with his Bankruptcy that he filed back in XXXX and she said no and that she could not tell me what it was in regards to, just that it was a civil matter. I then text my husband with the woman ‘s number frantically asking that he call this woman back. My husband then told me that the woman was calling about a Citibank Credit Card from XXXX and that the balance was {$5900.00}. My husband attempted to let her know that he had filed a Chapter XXXX Bankruptcy in XXXX and that it was discharged in XXXX and the woman proceeded to tell him that she was going to send the paperwork to our local jurisdiction, take him to court, garnish his wages and report this to his credit report. She told him that his bankruptcy did not matter. My husband then called me very upset and I let him know to call her back and let her know that even if we did not know about this debt back when the bankruptcy was filed, that because his bankruptcy was discharged, this debt would have been automatically included as it was incurred BEFORE the bankruptcy was filed. My husband called the woman back who stated that she did not know who we were getting our information from and again stated that she was going to take us to court and garnish his wages and that this was an OPEN loan already on his credit and is not part of the bankruptcy and then told my husband to have a nice day and HUNG UP.
