Consumer Complaint: First Financial XXXX XXXX , XXXX, XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, GA XXXX is a collection agency purportedly attempting to collect a debt for XXXX XXXX XXXX XXXX, XXXX, address, city, and state unknown. XXXX XXXX purportedly purchased debt from XXXX XXXX, XXXX/XXXX XXXX XXXX XXXX, XXXX XXXX, UT.

Consumer/patient was covered by a XXXX insurance policy. XXXX XXXX was contracted as a preferred provider of XXXX. Consumer/patient obtained services on or about XX/XX/XXXX from XXXX, who billed XXXX, and received reimbursement pursuant to the contract between them. In accordance with the contract, balance billing is prohibited. In correspondence to XXXX, XXXX indicated the payment and contractual allowance amounts. XXXX further indicated the patient had no responsibility for co-pays, deductibles, etc. XXXX therefore received payment in full from XXXX, in accordance with their contract.

Notwithstanding payment in full, and instead of adjusting the remaining amount as the agreed upon contractual allowance, XXXX instead claimed the consumer/patient owed {$1500.00} and purportedly sold this debt to a different creditor, who then employed the services of the collection agency.

On or about XX/XX/XXXX, collection agency sent consumer/patient an ” Account Summary ” claiming to be acting as a collection agency on behalf of XXXX XXXX XXXX XXXX XXXX. They provide no other identifying information for XXXX XXXX. No address, no phone number.

On or about XX/XX/XXXX, consumer/patient sent collection agency a request to provide the name and address of the current creditor, the same for the previous creditor, supporting documentation providing a valid basis for the claim, a copy of the last billing statement sent by the original creditor, proof of state license to perform debt collection within my state, and proof of state license to perform debt collection within the state they’re based.

On or about XX/XX/XXXX, collection agency responded, but failed to disclose address and phone of current creditor, failed to provide copy of last billing statement from original creditor, failed to provide proof of license to perform debt collection within my state, failed to provide proof of license to perform debt collection within the state they’re based. Collection agency appeared to provide a copy of a lab order listing various charged and allowance. Collection agency provided a copy of a patient acknowledgement admission summary, with a section titled ” financial arrangements ”.

On or about XX/XX/XXXX, collection agency submitted a false and derogatory credit report to one or more credit reporting agencies. Said report was submitted less than required 30 day waiting period for consumer/patient to dispute debt.

Consumer/patient asserts XXXX, XXXX XXXX, and First Financial breached the terms as stated in the financial arrangements section. Consumer/patient further asserts that XXXX received payment in full from XXXX, in accordance with the contract between the two parties.
