Consumer Complaint: XX/XX/XXXX RE : Best Buy Account # XXXX, which Citi illegally sold to XXXX XXXX XXXX / XXXX XXXX. ( Also a Violation of Consent Order XXXX. ) Citis debt collector, XXXX XXXX XXXX DBA XXXX, is unlawfully attempting to collect on a phantom debt which Citi illegally sold to XXXX XXXX. Citi is ultimately liable for the conduct of its agents. I ask that Citi immediately remedy this unlawful conduct, including unlawful collection actions for a debt that I never owed and that would be outside the statute of limitations even if the debt were valid.

Specifically, the account balance was XXXX when I closed the account in XXXX. XXXX XXXX XXXX filed lawsuit around XX/XX/2017 but provided no validation of the debt showing why it claimed I owed any money to it.

Citi illegally sold the debt to XXXX XXXX XXXX, which sued me for the invalid debt by submitting a false proof of service to the court. I was out of state with my gate up at my house with nobody living at my house at the time the process server supposedly served the complaint. Other courts had found the process server to have filed false affidavits with the court, according to court filings.

XXXX is alleging an amount far higher than the underlying charge along with attorneys fees. However, I did not owe the underlying debt ; and even if I did owe the debt, it would have been outside of the statute of limitations. I should not be subject to paying for a debt I do not owe or be subject to default for a debt I do not owe. Citi and XXXX XXXX also failed to validate/verify the debt or forward my financial records to me regarding this debt. This is the most I can piece together since the lenders and XXXX XXXX refuse to give me a complete copy of my financial records and the entire file related to the account.

Citis conduct is in direct violation of Consent Order XXXX, which the CFPB ordered after it found violations very similar to my case. As such, Citi should be held in contempt and sanctioned.

I informed Citi and XXXX XXXX XXXX of their unlawful conduct, the falsified service affidavit and their many consumer violations in order that the lawsuit be dismissed. In response, the attorneys filed a request for default. In my opinion their conduct is unethical and unlawful. My requests were ignored and held against me.
