Penso Holdings, Inc is a California corporation and was registered November 13, 2007, just a week before the domain name for Capital Debt Settlement was registered.

Interesting Points

There is an attorney in California, Marc Gentry Penso, with his office listed at 4000 Barranca Pky #250, Irvine, CA 92604. It seems odd that there would be two people with the name Marc Penso doing business so close together. TASC lists CDS Resolution as doing business at the adress with the green arrow and the law offices of Marc Penso are located at the A.

It’s a small world after all. On April 4, 2012 Marc Penso the attorney added the following comment to clear things up.

“I am Marc Gentry Penso. I am the attorney with an office at 4000 Barranca Parkway, Irvine, California. I am NOT the Marc Penso that is connected with Penso Holdings, Inc, 8781 Crescent Drive, Huntington Beach, CA 92646, I have NEVER been connected in any way with CDS Loan Services or CDS Debt Resolution. I am a Licensed Real Estate Broker, in good standing and have NEVER been reprimanded. Feel free to look up my licenses and good standing status with the California State Bar and the California Department of Real Estate.”

Capital Debt Settlement announced on March 19, 2009 they were now sending their debt management clients to Allegro Law. Allegro law was soon shut down by the State of Alabama and the attorney in charge of Allegro Law lost his law license.

Capital Debt Settlement is the outsource company for Legal Helpers to provide debt settlement services for Legal Helpers Debt Resolution. – Source

I find it very odd that it is so difficult to find who actually owns Capital Debt Settlement and the entity that owns the company.

It is also very strange that they do business under the name Capital Debt Settlement but the link on the bottom of their site for their TASC membership takes you to a page that identifies them as CDS Debt Resolution but the actual TASC disclosure statement identifies them as Capital Debt Settlement. Who are they really? – Source. At the time of this review if you entered CDS Debt Resolution into Google the only two sites in the world that had information on that company was the CDS Debt Resolution web site and TASC. – Source

I found some glaring inaccuracies in the way they portrayed bankruptcy on their site while appearing to sell debt settlement as the preferable solution. – Source

The company also appears to have been running ads claiming they could underwrite apparent loans under the Consumer Debt Initiative, which is a misleading and non-existent program. Match the phone number on this ad that ran. – Source

Marc Penso was operating as a real estate broker in the State of California without a license and was sanctioned for this on April 9, 2009.

The Real Estate Commissioner of the State of California has determined from the findings set forth below that you PENSO HOLDINGS, INC, dba CDS Loan Services and MARC PENSO have violated Section 10130 of the Business and Professions Code (hereinafter “Code”) by engaging in the business of a real estate broker within the State of California without a real estate broker license.

During 2008, you have engaged in a business, for or in expectation of compensation or collection of an advance fee, you solicited or offered to provide loan modification, re-finance of a loan, or short-sale negotiation to owner of real property to modify terms of the loans on the real property. – Source

  3. Do not deal with Capital Debt Settlement. I have had several conversations with David Henson (company president) and he is very knowledgeable about the settlement process. Unfortunately he has no scruples. At the exact point in which I had paid their fees in full they dropped my account and took my money. I will be suing them and one way or another I will be getting my money back. Furthermore, for those reading this that are in deep debt that need settlement services, save your money and do it on your own. I have settled two accounts on my own thus far without the help of CDS. They do not do anything (other than take your money) that you cannot do by yourself. Don a thick skin and deal in a harsh but business like manner with the collectors – don’t believe their lies – you have rights. Save up and settle each account one by one. If not sure how there are self help settlement kits that cost a couple hundred dollars. Get a pre-paid legal service for $20-30 per month to write or proof read all your legal docs. You have rights and can do it yourself if you hang tough. CDS will set you back by thousands of dollars and will not settle your accounts. They are crooks.

  5. I noticed that you have several articles about Legal Helpers and CDS client Services. I wanted to shed some light on this matter for you as well as kind of tell you HOW they operate.

    Well, lets start off with legal helpers as you may know they sell their name to be the front cover for many unscrupulous debt settlement companies taking advantage of consumers such as CDS Client Services located at 2152 Dupont # 101 Irvine, CA owned by Steve Brennen who has two guys run the place for him by the Names of MARC PENSO who incidentally has a CEASE and DESIST letter from Department of real estate and DAVID T. Henson who is the President(one of Steve Brennen’s Goons).

    basically what legal helpers do is go around selling their names(it even says in their contract that they have a NON-Exclusive agreement) as I know of other companies that bought/paid for to be able to use their name which involved macy aleman attorneys coming to your office for a “sales pitch” and then basically take money for clients they(debt settlement companys such as CDS client services enrolls) but there is no attorney involvement whatsoever, they say they are compliant however its business as usaul and they take money from consumers yet do not provide any REAL services.

    The latest thing to come down the pipe is that for the next month they will not be enrolling NEW clients as they are TESTING some enrollment procedures (all B.S.)

    Bottom line these guys(CDS client Services, legal helpers) are just not legit! not only that macy aleman’s offices is headquarter in IL they just CON other lawyers to join their circle(to bear the legal helpers name) just so they could say they have lawyers in 50 states but IN REALITY they are BASED in CHICAGO and just pay to use other attorneys’ names on their letterhead all in all they are a NAME MARKETER LEGAL HELPERS and THE REAL SERVICE providers are the debt settlement companies that pay to play

  7. i joined with CDS client services last Sept. they started debiting out money from me in Oct. 09. They have not paid any of my credit accts. yet. Only paying fees, they say still. I am now served with papers by a large bank I owe for credit card balances. Will this co. (legal dept. ) be expected to answer the papers that were served me today for a mediation? Have you heard any negative things about CDS client services of Irvine, Ca.? Help! Thanks!

    Should they represent me in answering this summons?

      It is unlikely they will provide you with legal representation with a lawyer in your state. It will be your responsibility to defend yourself against the lawsuit but I’m not sure what the defense would be since you are sending money away each month to CDS instead of the creditors.

      No debt settlement company can stop a creditor from suing you and sending money to a debt settlement company instead of the original creditor only seems to encourage people getting sued.

      I would do two things. First, you should call CDS and discuss the situation with them and ask them bluntly if they will assign a lawyer in your state to deal with this situation. If a customer service representative wants to give you advice about how to respond to the summons, don’t follow it. They can’t provide you with legal advice.

      Now you may come to the realization that all you’ve paid are fees into a debt settlement program, have received little help or benefit from it, and want out. If that’s the case then you may want to read How to Get Out of a Debt Settlement Program and Get a Big Refund.

  8. I worked for a company like this. I left because i couldn’t handle it anymore, they are ripping off clients and misleading them. The sales people make is sound so great when really its not so great. The creditors can still take legal action against them. They are not retained by an atty. They are told they have legal representation but they DO NOT. The clients should not pay for services they can do on there own. The creditors can continue to call you and they will.
