Our Mortgage is in Default But Bank Did Not Foreclose. – Kal

Husband laid off for over a year, went into foreclosure, stopped the foreclosure in the 14 day period with the bank attorney. Called to check status and the attorney said the case was closed? Have not heard anything from the bank except they were not going to foreclose. We did have a discharged bankruptcy in 2006 and reaffirmed our mortgage then. Don’t know what to do next. Husband now has good full time job and we can afford to keep our home.

Have talked to bank only for them to say the account is with a different department and they will call this is since January. What is going on?

Dear Kal,

Are you making at least the regular mortgage payment now? If not you need to keep calling the bank for answers. You don’t want to be surprised by something coming out of the blue.

You need to be proactive in this situation, not reactive.
