Being sued up to 1 Million, Don’t have close to what they’re asking for.
I was recently in a car accident that had caused 2 people to be placed under life support, they are both up and both perfectly fine, 4 months after. I just got news that they are filing a lawsuit for up to 1 Million, as there insurance states. My liability only supports up to $250,000, so they are calculating my assets to see if i’m worth more then $250,000, If I am, They are sueing me for up to 1 Million. Is there anything I can do to get out of this, I mean this is my life. My life is gone if this lawsuit is proceeded through me. I don’t have anywhere near 1 Million but i’m not sure if I have more then $250,000. Is there any way to get out of this? I’m in debt in alot of places, calculating the “Might be worth more then $250,000″ is including my life savings, what’s paid on my morgage, and my vehicles I have remaining left. I’m badly in debt in my gas station, the loan on that is a 2 way split between 1.2M, and it’s currently worth around 750. Just that is -450k. Not including my credit card debt being owed 30k on my Discover card. Is there anyway to get out of the lawsuit? I can barely survive now, If it goes through me, I won’t be able to live at all after. I’m not sure if the resulting debt can be discharged by bankruptcy. You’d need to click here to find a local bankruptcy attorney to talk to about that.
The issue is that debts arising from divorce, breach of fiduciary duty, larceny, or “willfull and malicious injury” to a person or property are typically not dischargeable in bankruptcy. The bankruptcy attorney will be able to help you with your specific situation.
