I filed chapter 13 1 year ago. During the initial counsult with my attorney I informed him that my income looked high because of the overtime I had been working. I also told him that I can’t count on the overtime being there. So off we go into a payment plan based on my income including the tons of overtime I was previously getting. No the overtime isn’t there like it used to be and I am now getting behind on other monthly payments but the chapter 13 gets paid through an alottment. Also can I convert to a Chapter 7 ??? What is the time period for doing so????
The chapter 13 gets paid right out of my paycheck and I have hardly no money left over to live on??? Talked to my attorney 1 week ago with no response??? What can I do. I’m sinking further down the hole
Just keep nagging your bankruptcy attorney for a payment modification. This is a fairly common process and with documentation the bankruptcy trustee will probably accept the modification.
