hired a law firm in ca who said they woud get us a loan mod. pd 3400. thy did not do anything for us. can we get our money back from them. i don’t think they r doing loan mods anymore. anita pieratt is the law firm. i am working on loan mod myself now.

Dear Michaele,

You should start any refund process by contacting the law office and asking for a refund first. If they are not willing to provide you with a full or satisfactory refund for loan modification work you can follow this process for refunds. While the process is directed at debt settlement companies it is the same basic refund process for all debt relief services.

Now if the law office can demonstrate they have performed work for you on your behalf they may withhold part of the refund to cover that work. If you wind up at the end of this process unhappy with the results then you always have a right to file a complaint with the state bar association against the lawyer.

  1. I also paid the law Firm of Anita Pieratt to help with a loan modification. I did not get any help from her firm. I found them to be so disorganized that I actually asked them to quit helping. They acted like I was bothering them because I wanted to know what was going on with my loan modification. I have a paper trail on them in which I turned into the Orange County Bar since she would not refund my $2500.00. The Orange County Bar wants $175.00 to sent her the complaint. I will not give any of these people any more of my money. I am now paying someone else.

    • I too hired this firm to help with a loan modification that went nowhere, I have been waiting for the remaining half of my moneyback guaranteed refund for 3 months now, only to be told the refund is contingent upon Anita selling a house. I have all of my documentation and will be filing complaints with the appropriate parties to ensure this doesn’t happen to anyone else. it’s complete BS.

      • I filed a complaint with The Orange County Bar Association and they are actually checking into this. The burden of proof is on Ms. Pieratt. She is disorganized, defensive and flat out useless. I wish you well.

        • Just to keep everyone informed, I had contacted the Orange County Bar regarding not getting my loan modified, as per the agreement in Ms. Pieratt’s contract.  Well I will have to report that Ms. Pieratt did not even reply to them and I was told I would have to pay a $175.00 fee to abritrate my fee problem with Ms. Pieratt.   I decided to drop the whole thing because I will not pay attorney’s anymore for any of their help regarding this matter.  My conclusion-Ms. Pieratt knew exactly what she was doing when she set up the contract, knowing how hard it would be for the average person “with a beef” to get help from anyone.  Her not even replying to my complaint to the OCB shows how the attorney system works.  An expensive lesson for me.

  3. i finally filed a complaint w/the bbb. u should do also. if they get enough complaints maybe we could get our $ back. i will bet there are more complaints against them out there. i have a feeling its not just us. i finally took over myself and am handling the loan mod. at least i am kept in the loop. i started googling loan mod help and found some great resources. let me know. really though you should file a complaint w/california bbb. anita pieratt law firm is a rip off. they didn’t help me at all. they should be stopped

  4. I’ve had the same experience. I paid Pieratt Law for refinancing, then turned all of my documents into them. That was 6/09. The attorney handling my case has been ‘fired’ and a new one assigned. They asked for the same documentation. I emailed it in to their clerk three weeks ago. When I inquired today as to whether they received it, they said they hadn’t an a suspension letter had been mailed to me regarding my account. I never received that. I reforwarded my documentation to the new attorney who will (hopefully) reopen my account. This has to be the most unprofessional law firm I have ever dealt with. I’d be interested to learn if there have been more complaints about this firm.

      • I have filed a complaint, with an awesome paper trial, to the Orange County Bar Association, the bbb and the California State Bar Association. The Orange County Bar Ass. wants $175.00 just to contact her. They will not get any more money from me.
        Have not heard from anyone else. I just want my money back. I am paying someone else since Anita and team are totally useless.
