Can a Creditor Sell My Debt They Can’t Validate?

“Dear Steve,

Last month I received a letter from a 3rd party collector saying I owed $786.00 on a cell phone account. So I practiced my rights and sent them a letter requesting full validation of the debt. It has been almost 40 days and I never received any letter or documents back showing they owned the debt, could collect in my state, that I owed the debt, how they figured this amount I owed, and etc. Instead I received a letter from a new collector collecting on the same debt. It has not been placed on my credit yet by either company. So I sent the new company the same validation letter a few days ago.

My question is since the first company has failed to provide me validation of the debt, can they just sell the debt to another company when they did not provide me the documentation that I requested?”

It sounds to me like they could not provide you with the debt validation data you requested and passed the buck. They most likely sold the unverifiable debt on to another debt buyer.

The good news is you know exactly what to do. So take your previous process and just follow the directions on the shampoo bottle; Rinse, lather, repeat.
