The Franklin Group – Consumer Complaint – November 7, 2012

Consumer Statement:

I had recently applied for a mortgage, and Stephen Shiver from The Franklin Group (TFG) contacted me, misrepresenting himself as a mortgage broker. He did this by stating that he had received my application for a mortgage, everything looked good, and that if I was still interested in obtaining a mortgage, to contact him right away so that we could get started.

I obviously did, only to find out that he was actually from a credit repair company, and started his fast-talking to swindle $199 down + $99/month until my credit score was “repaired” by TFG. He is a born salesman, and so I jumped on-board this process, signed the electronic contract, and submitted all of the documents they stated were necessary to have in order to get started. However, I started to realize little things that just were not adding up, like that as soon as they started responding to me after the contract was signed, the e-mail addresses were all “g-mail& quot; accounts, and were no longer “” accounts, and I began feeling very leery and uncomfortable.

I looked them up with the BBB, and realized why I was feeling so uneasy about my situation, b/c they are a scam outfit, and they profit from other people’s misfortunes and take advantage of people who are already down. I called Mr. Shiver and also my case worker, Diedre Small, who assured me I was worrying for nothing, even though they refused to give me a direct, verbal answer to my inquiries re: the cancellation form. They simply said I had to read it and I could sign it and return it if that’s what I wanted.

The cancellation form has a box to check that says, “I hereby cancel this transaction”, and if that box is checked, it makes the cancellation null and void, and you will continue to be billed indefinitely. I did not check that box, but upon Mr. Shiver reading my cancellation form, he stated that he would “try” t o get a refund for me within 90 days! I had not paid any money yet, but he made it clear that he was going to charge me for it, and then would ALLEGEDLY refund the money 3 months later…which I do not believe.

Consumer Action Taken:

I spoke with everybody I could contact from The Franklin Group, but even the way they have their website set up is deceiving, b/c you cannot access any supervisors, or anybody whom you have not already dealth with, due to having to enter the name of the person you want to speak with. If you dial “0”, you will get the case manager I spoke of, Diedre Small. I have e-mailed and called, but have gotten nowhere. I have reported them to the BBB, though, and am awaiting more information regarding how I can help people who are already down on their luck, avoid further scamming by this company.
