My VA Mortgage is Being Foreclosed on. Will They Garnish My Social Security? – Harlan

“Dear Steve,

I am 68 years old and I draw social security retirement benefits. I also work as a sales associate for a retail company I hav a va home loan that is in forclosure.

Can the va garnish my social security retirement benefit? Also, can they freeze my bank accounts?

Dear Harlan,

That is an excellent question. Since the VA loan seems to be a government benefit then typically the government could garnish you social security for money owed the government.

In fact the VA does not lend the money and it is not a government loan. There would be no Social Security garnishment simply because of the VA loan default. However, if you ever wanted to use those VA benefits you would need to repay the VA for the loss on the loan they guaranteed for you. The amount varies by loan amount and type. – Source

The VA offers a number of assistance programs to help keep you in your house if you can afford it.

If you have other debt you owe along with this loan and you can no longer afford to manage your debt, then you should talk to a local bankruptcy attorney.

You can click here to find a local bankruptcy attorney and talk to them for free about your specific situation. Get the facts and then you can make an informed and educated decision if bankruptcy is right for you.
