“Dear Steve,

I got a $400 loan from American Web Loan and made my first payment to them. Then I called them and wanted to pay off my loan early and the said I would make a payment and they would take out their $120 loan fee and apply $80 dollars to my balance.

I would have to let them know three days early before my payment was due. I placed a Stop Payment on my checking account and drew all my money out.

The next payday they had taken $120 out of my account and $20 dollars the day before. I still owe the same $400. As far as I can see on my state government website, they are not licensed to do business in my state.

What can I do and what should I do to pay off these crooks? Thanks for your time and energy.

Dear Earnie,

Well this is going to get nasty quickly without some intervention.

I think the most reasonable and best approach in this situation is for you to reach out to them, in writing, and let them know your intentions were to repay the loan. Don’t jump on them with a chip on your shoulder, do it with a level head.

If they decide to not just deal with this then as this escalates you will appear to be the reasonable and level-headed person.

I’d follow the process I lay out in this guide. While that guide is for a slightly different issue, the process and escalation procedures are still the same.

Or, if you don’t want to deal with this then just skip ahead to filing a complaint with the authorities identified in the guide. Most importantly, your State Attorney General office.

My only concern with going that route first is the complaint process will take time and if by some magical means the company comes out legitimately able to collect the debt then your balance and penalties would be significantly higher.
