I Have Fibromyalgia, PTSD, and a Lot of Medical Bills. – Cyndi

“Dear Damon,

I’m 54 & don’t work due to Fibromyalia & PTSD? I don’t get any disability. I was denied because i don’t have enough credits. My husband is 60 & receives $1474.00 from S.S. Disabilty. He had a stroke in 2007. That is our only income.

I was hospitalized 12/2010 from internal bleeding & had to have 3 blood transfusion. I had no insurance. I now have a $19,000.00 hospital/Dr. bills. I didn’t qualify for Community Care through the hospital because of my husbands inheritance.

His inheritance is set up with his 5 other siblings which include land & stock. He can’t sell his share unless all the other siblings agree to sell. They are now trying to dissolve the LLC. We also have $12,000.00 credit card bill that my husband was using for everything during a 4 month period when we had no income whatsoever.

I believe this was when i was sick. (I was ‘doctoring’ from 12/2010 to 6/2012 – getting blood checks). We talked to a lawyer about bankruptcy & he said if we filed bankruptcy, & later sold his inheritance, he would lose his inheritance. I don’t understand this. So now we are paying $353.00/month for the credit card. My hospital/D r. bills were turned over to collections & am paying $25.00/monthly. That’s all we can afford. Any suggestions?

Hello Cyndi,

It appears that the inheritance is what is causing you the hiccup because while it has value it isn’t liquid. You are not going to make a dent in your credit cards or hospital bill on only 1474 a month so paying the 353 to the credit cards is likely just throwing good money after bad.

What do you estimate the value to be of your husband’s share of the inheritance? You mentioned dissolving the LLC. Does that mean the siblings are in agreement to sell the land and stock and cash out?
