Consumer Complaint: The nature of the problem is that I feel that credit acceptance took advantage of me. In XX/XX/XXXX, I went to XXXX XXXX to purchase a XXXX XXXX XXXX. I was paying {$290.00} on it and within a month, the car stopped and they told me they could not fix it. So I had to fix it myself. I believe they sold me a car that was auctioned off somewhere because it had a crack in the window and it started acting up as soon as I got it. I believe they deceived to think that they checked the car completely before they sold it to me and I also placed GAP insurance on it. After a few months from automatic withdrawal, they started adding on fees when I was late. Every time I was caught up, they added on more fees and they repossessed my vehicle twice. The first time, it was after hours around midnight which is against the law. It was suppose to be around business hours. I thought my car was stolen, so I filed a police report. After I had to pay {$500.00} plus the car note and extra fees, I was then able to get the car back but my nightmare wasn’t over. They harassed me every single day from XXXX to XXXX and when I answered, the representatives were very rude and stressed me out even more. The second time they took, I voluntary gave it to them because the stress I had endured with giving them everything I had made me give up. I have a witness they will testify to all of this. Their practices are illegal and they do not inform their customers on procedures and terms of the contract once it has ended.They sold my vehicle for {$2500.00} and sued me for {$12000.00}. They started a garnishment in XX/XX/XXXX without any warning or notification to me to respond to the garnishment. It was placed on me by default, which I’m pretty sure they knew they would win. Because I was unaware of the garnishment about to take place, I was unable to answer and they won on default. My wages started getting garnished in XXXX and still getting garnished. I’ve been faced with getting evicted from my home, delinquent bills, no vehicle because of what they placed on my credit report. They have taken over {$6000.00} of garnishment from my paycheck. Based on the principal balance, I have paid off the balance that was explained that I had to pay. They told me XX/XX/XXXX, that I will not be able to have it removed from my credit report until attorney fees and interest is paid and that it wouldn’t be done until after 60 days instead of 30 days based on the FCRA. This was not discussed to me when I was signing a contract with them when I purchased the car. They are getting over on me and have made my life a nightmare. I’m a single mom with XXXX kids, no car, and I desperately need justice for what they out me through. I’m seeking a resolution for distress and financial turmoil. According to my credit report, my balance is the only thing that is showing on there that had to be paid before it will be removed. Now, they are talking about attorney fees and interest and they are doing this because they won a judgement that was unfairly granted to them without my response to anything. I believe it is against the fair credit reporting act and against proper procedure of reporting the right amount for the debt to be removed from the credit report.
