My sister is on social security she is 76 years old she has recently been harrassed by lvnv about a 8 year old debt they have gotten a judgement against her and have been taking her social security out of her bank bank of america the recent amount they took was everything she had when she called the bank they told her that lvnv had a written ok by my sister to take her money she didn t sign anything she is at her wits end please tell us what to do
In August I got settlement offer out of blue from Brachfeld Law Group representing LVNV Funding, sent DV letter, no response. Wrote LVNV directly with DV demand-no response. Wrote original creditor asking for proof of assignment/sale-got signature card from 2004 on old account. Resurgence Capital answered query from WA state D.A with admission SOL expired and claiming they bought account and turned it over to LVNV Funding. I wrote Resurgence asking for proof of standing/bill of sale-silence. Meanwhile monthly LVNV reports me as delinquent to all three credit reporting agencies. Disputes resulted in ‘dispute investigated, complies with FDCPA. So now I filed fraud alert and consulted attorney re; fraudulent claim by LVNV. Ideas?
