Consumer Complaint: I had merchant services with Bank of America for a credit card terminal for my business. 2 years ago, we decided to cancel this service and go with another company. BofA advised that I need to return my terminal equipment and my services will be cancelled. I returned the equipment as they advised.

Just recently, I was going through my bank account statement noticed that every month BofA withdrew two separa te payments of {$19.00} and {$20.00} from my account. I called them to ask what this is, and they said that this is for the merchant service terminal that I currently have, even though I have n’t had this service for 2 years. I told them that I returned all my equipment, and that it should automatically be cancelled once they received it. They advised that after I returned the equipment, I was supposed to call them and personally tell them to cancel the service, even though they never told me this. How does this make sense? If I do n’t have your equipment nor your service, how are you still charging me for leasing your equipment? This is the same thing as leasing a vehicle, returning it when the lease is up, but they still charge me every month for the vehicle because I did n’t call them to cancel it. This is FRAUD.

I spoke to many different people from BofA, includin g supervisors and managers. A lot of them were silent and could n’t give me an answer because I ‘m sure they knew it was illogical. They just kept repeating that I should have called them and cancelled. Some even said that XXXX XXXX ( the terminal company that BofA uses ) is the one who ‘s been charging me, and not BofA. I called XXXX XXXX and they did indeed see the charges, but confirmed that it was BofA sending the charges. So we conference c alled BofA with XXXX XXXX and they exp lained to BofA that this was Bank of America sending the charges, and BofA agreed.


BofA finally can celled ( last month in XXXX ) th e services that I never had for 2 years, but I need them to refund me all of the money that they ‘ve been withdrawing from my account in the past 2 years. This is fraud. They ‘ve literally been stealing money from my bank account for services I never had. This is similar to the XXXX XXXX case, and will not be tolerated.

I will take this to court if it ‘s not resolved here. This is unacceptable.
