Consumer Complaint: I am writing in response to a collection company ( Second Round LLC ) that is reporting an alleged debt ( # XXXX ) on my credit report that they have not, to date, been able to provide me with supporting legal documentation stating that ( 1 ) the debt belongs to me ( 2 ) the fact that they have the legal authority to collect anything from me.
I have sent this company debt validation request multiple times, disputed this alleged account with XXXX, XXXX and XXXX when I first received correspondence from them in 2016. In return, ( Secound Round LLC ) sends me an acknowledgement of my request for validation and ask for me to supply ” their company ” with documentation of my personal information in order to validate this account. I ‘m baffled because I do n’t understand, how they are validating the information with the credit Bureaus but do n’t have the information?! This derogatory information remains on my credit report to date without being validated. How does this happen? How is that even possible?
I initially disputed the information with Second Round LLC back in 2016 requesting debt validation to include the alleged balance and calculation from the opening to the closing of this account, it being sold or transferred, proof that the account is correct and information that the statute of limitations are valid with the alleged account and have not expired, signed documents showing that I agreed to pay this debt and agreement that grants them the authority to collect this debt. To date, I have not received any legal obligation from them that I am responsible for this debt. The company in question Second Round LLC, has been unable to provide me with any form of legal validation. This is inaccurate
information and therefore ; according to the law should be deleted from my report because it has not been validated by the company actually providing the information. I am asking for a complete removal of this account from all three of my credit reports immediately. Per the FCRA, the credit bureau is required to report timely and accurate data and any inaccurate information that can not be validated should be deleted.
