Consumer Complaint: At XXXX XXXX EST on XX/XX/XXXX I contacted XXXX XXXX XXXX XXXX XXXX owned by TCF bank to attempt to settle on a debt that I had on my vehicle loan. The representative that I spoke with XXXX XXXX was rude and abrupt. He very early in the call stated he believed I never had any intention on paying the debt. I advised him that it was uncalled for and he didn’t have the right to be condescending or rude to me, that I called with every intention on setting up a settlement. He then proceeded further in the call to advise me that it was likely in my best interest to get a bankruptcy lawyer and stated that I should do it today, possibly after our call and that my credit would be very negatively impacted by the balance. I advised him that I was well aware of the debt and that was why I was calling and that the loan had already been charged off. There was no justifiable reason for him to do this. I felt threatened, and that he had mischaracterized me. I then requested to speak with a supervisor but he continued to speak down to me and refused to honor my request to speak to someone in management. He proceeded to be rude and snide with me during the duration of the call. He even at one point chuckled on the line. At this point I demanded a supervisor which he then finally honored my request and transferred me over to XXXX XXXX who stated he was the supervisor the delinquency mititgation department. He proceeded to reassure me the call would be reviewed but didn’t see very interested in the fact that XXXX XXXX. I am also reporting this to FTC, XXXX and looking into pursuing legal action due to the infraction that took place today. This was not the first time I have had an incident with XXXX XXXX XXXX XXXX XXXX. In a previous call made in XX/XX/XXXXa representative told me that although the vehicle was totaled they could still send out a repossession agent to the home and bill me for it in a malicious attempt to collect a payment and in a call prior to that a rep told me that collection laws were updated and that XXXX XXXX could start reporting me late to the credit bureau even if it was 1 day past due. After all of the abuse and harassing phone calls I am now submitting this because I feel the entire organization needs to be investigated for false claims and laws which are a direct violation of the FDCPA. I am requesting a higher representative contact me immediately concerning this matter and all recorded calls need to be listened too.
