Product: Medical debt

Issue: Attempts to collect debt not owed

Consumer Consent Provided to Share Complaint: Consent provided

Consumer Complaint: A debt that has been fully investigated has been permanently removed from XXXX and XXXX Credit Bureaus years ago. It remained on XXXX and have disputed this debt numerous times. I have provided all documentation and proof that this debt is not owed. That in fact, XXXX XXXX XXXX was paid by XXXX XXXX XXXX XXXX of Texas after the XXXX doctor ‘s office submitted the required proper forms, just like they did with my son during the same appointment time. The email I provided shows that the Dr ‘s office made a mistake and that everything would be resolved once they submit the form they’re required to send in. They even apologize in the email. No procedures were started or completed that was not covered by our insurance. A doctor ‘s office verifies insurance before patients are allowed into the back offices. Insurance was verified. The XXXX Dr ‘s office was paid. However, they reported this office visit as a debt to credit bureaus until they were paid. That’s when I disputed it. It was investigated and removed from XXXX and XXXX credit reports. XXXX XXXX associates removed the trade line with all credit bureaus and then sold the debt they were reporting and I have been disputing it ever since.
-Letter ( Exhibit 1 ) to XXXX requesting an investigation for debt Capital Accounts reports on my credit file.
-I sent Certified Letter dated, XX/XX/XXXX, to the debt collection agency and requested they validate the said debt ( Exhibit 2 ).
-They signed for the letter XX/XX/XXXX ( Exhibit 3 ).
-I have provided their response letter for your review ( Exhibit 4 ). *Not only are they reporting a debt that is fraudulent, they are also adding to the amount which they aren’t allowed to do.
-Additionally, ( Exhibit 5 ) is a direct violation of HIPPA . Capital Accounts sent me a document which contains medical information of a minor. Procedures completed and the diagnosis of the procedures. A debt buyer is not to have access to medical files. Companies or Medical provider may not pass on ANY medical records when selling a debt to a debt buyer. This is very illegal. This is what has occurred.
-I immediately completed a research request form ( Exhibit 6 ), a dispute letter ( Exhibit 7 ), and provided all the documentation ( Exhibit 1,2,3,4 ) that XXXX has already seen and ignored, as well as email ( Exhibit 8 ) from XXXX XXXX XXXX back on XX/XX/XXXX and a notification from XXXX dispute results ( Exhibit 9 ) stating they have fully investigated and it was deleted from my credit file.
I request an investigation by your organization. Numerous laws have been committed and it is all of a debt that is not owed. I request you to please hold Capital Accounts accountable to their illegal credit reporting practices. Please notice that another increase on my credit report has occurred again today, XX/XX/XXXX. Capital Accounts also reports monthly lates/past dues to credit bureaus. They should be held accountable for their criminal, deceptive behavior. I do not owe this debt!
I thank you very much for your time and assistance.
