Consumer Complaint: On XX/XX/XXXX I received a collection letter from Total Card , Inc. in XXXX XXXX, SD attempting to collect a debt for {$18000.00} for XXXX XXXX XXXX. Having never had a loan with XXXX I contacted XXXX XXXX and they informed me this account was for a loan in XX/XX/XXXX. This company is trying to collect a debt that is 13 years old and that is in clear violation of Florida law : Fla. Stat. Ann. 95.011 et seq. which contains a limitation on collections of writing contracts to 5 years. Furthermore, this company is in violation of the Fair Debt Collection Practices Act ( FDCPA ) for attempting to collect a debt that is 13 years old and exceeds the statue of limitations for a collection agency to collect a debt.
