Consumer Complaint: Immediately after receiving a notice of ” attempt to collect a debt ” I wrote the collection agency, FIRST CREDIT SERVICES via certified mail requesting DEBT VALIDATION. In addition I gave them a phone call advising them that I do not owe any debt to them and asked that they provide DEBT VALIDATION ( proof of how I owe the alleged debt and how they came up with a combined balance of {$360.00} as they are reporting on both my and my partners account saying we owe a balance of XXXX each. ) I owe no debt to this collection agency. I have no contracts with the collection agency, contracts must be SIGNED in order for them to enforced. I advised FCS that I owe no debt to the party that they’re representing. As per my contract with XXXX XXXX I had to give a 30 day notice of request to cancel. I followed all instructions given by a representative at the XXXX, Tx location. I wrote my request to cancel to the following address, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Tx XXXX in XX/XX/2018. Advising XXXX XXXX that I would like to cancel my membership and asked that the cancellation be effective immediately. In XX/XX/2018 I noticed they were still drafting funds from my account. I called the number given back and let them know they’re still drafting funds from my account. I called and reminded them that I sent a notice to cancel the previous month and advised them not to pull from my account again. I also called my bank to stop the drafts from the cancelled contract. In XX/XX/XXXX and XX/XX/2018 I received a billing statement from XXXX XXXX asking that I make a payment for I believe the months of XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. This prompted me to call nd write XXXX XXXX and remind them once more that I cancelled my contract and asked that they stop sending me billing notices as I cancelled my contract in XX/XX/2018. Recently, I noticed that FIRST CREDIT SERVICES placed this debt on my credit report. The refused to answer to my request of debt validation and is in violation of the FDCPA as they have refused to provide the information and details such as how they came up with amount owed after my advance 30 day notice to cancel? A contract proving that I agreed to pay after dues after I gave a request to cancel. I demanded that they delete this inaccurate and false information off my credit report. They reported it knowing that it was inaccurate and false as I mentioned it to them. They are in violation of the FCRA/FDCPA! XXXX XXXX has serval bad reviews on the XXXX website for this same reason. They use a third party to take in cancellation request and somehow it never gets taken care of, how strange … I think it’s a tactic to keep consumers in contract and take their hard earned money. I did what I was asked per my contract terms and I demand that FIRST CREDIT SERVICES delete this inaccurate information from my credit report! It has hurt my scores and makes me look bad in the eyes of my creditors.
