Consumer Complaint: This is the second complaint I have filed against this company since XXXX, and I believe this latest tactic is a retaliation for the steps I have taken. Westlake Financial was contacted in XXXX after our issue was settled with the help of your office. During our conversation they offered to defer my XXXX payment until the end of the loan. I agreed to this. That should have negated my XXXX payment and made me only responsible for my XXXX payment.
My XXXX payment was due on XX/XX/2018 and is scheduled for XX/XX/2018 of this month. I received a letter on XX/XX/2018 ( dated XX/XX/2018 ) that stated the following : ” Your account is in serious default. Please be advised that your account has not reached the stage where definite action must be taken. We have begun a review of your account to determine what further collection efforts are required. Those actions may include steps to protect our interest in the secured vehicle, up to and including repossession, according to the terms of your contract. ” I find this amazingly aggressive for a 15 day delinquency and feel this is absolutely a response to my asking for my records to prove that they did not harm my credit as they threatened to when I refused to answer their question regarding why I was late. I was told that they would put that I was non-responsive to their claim, when that was not true. The resolution was that they told you they didn’t have that in my record and would not release any part of my file without a court order.
