Consumer Complaint: I pulled my credit report and noticed that XXXX and Equifax were reporting a derogatory mark on my credit from XXXX XXXX XXXX. I sent a letter to XXXX and Equifax via certified mail ; disputing the validity of them posting this on my credit report and asked for verification that the debt was owed and that it was mine, as well as proving that I owed the debt from my wet signature and that all documentation be verified with my social security number, date of birth, address and phone number. XXXX wrote back saying they are unable to verify the information and that the information would be removed. It was removed from my XXXX report within 30days. Equifax simply responded by saying that the account was verified and that the amount was updated but the account would remain on my Equifax report. Per the FCRA, this is illegal reporting and is not considered verification of indebtedness by Federal or State statutes. We have been given specific instructions by our legal counsel, to file a complaint and send Equifax another Validation Letter before proceeding with a lawsuit. They have not been diligent in complying with the FCRA, Federal or State statutes and we seek to have the account removed immediately and an updated copy of the Equifax report mailed to my address.
