US Fidelis, Darain Atkinson, Cory Atkinson – All Indicted by Grand Jury

Attorney General Chris Koster yesterday announced a St. Charles County grand jury has handed down a 14-count indictment against Darain Atkinson and a 13-count indictment against Cory Atkinson, the brothers who owned and operated US Fidelis. US Fidelis was formerly known as National Auto Warranty Services and did business under the name “Dealer Services.” The indictments include felony charges of unlawful merchandising practices, stealing, and insurance fraud. The Attorney General’s Office, working in coordination with St. Charles Prosecuting Attorney Jack Banas, requested the indictment, and the Attorney General’s Office will prosecute the case.

According to the indictments, the Atkinsons and their company sold vehicle repair coverage under both vehicle extended service contracts and contracts associated with various vehicle products.

The indictments allege that the Atkinsons:

  • kept refunds that were due consumers;
  • charged fees in excess of the amount stated in the contract; and
  • told consumers they would get a pro rata refund if they canceled the contract, while intending to keep a portion of any refund.

The indictments further charge that the Atkinsons misled consumers into believing:

  • the company was affiliated with auto manufacturers and dealers;
  • the consumer’s warranty had expired or was about to expire; and
  • the consumer had the opportunity to extend or reinstate the manufacturer’s warranty.

According to the indictments, the Atkinsons also falsely represented to consumers that all vehicle repairs were covered and concealed from consumers the fact that the coverage contained liability limits and other conditions and exclusions from coverage.

The indictments also allege that Darain Atkinson is a prior offender as a result of a 1986 conviction of theft, forgery, and burglary in Kansas and a 1987 conviction of manufacturing counterfeit Federal Reserve Notes in the U.S. District Court, Kansas, and that Cory Atkinson is a prior offender as a result of a 1997 felony criminal trespass conviction in Colorado.

If convicted, and because of his status as a prior and persistent felon, Darain Atkinson could face a term of up to life in prison. If convicted on the most serious count, Cory Atkinson could face a term of up to 15 years in prison.

The charges against Darain and Cory Atkinson are merely accusations and, as in all criminal cases, the defendants are innocent until or unless proved guilty in a court of law. – Source

  1. Darain Atkinson funneled funds from U.S. Fidelis through his wife, Miyong (Mia) for years. Miyong’s parents were poor when she married Darain. Now they own three homes, wear Rolex watches, drive a Mercedes; nonetheless, they’ve managed to stay out of the spot light and was not named in the bankruptcy complain brought forth by the creditors of U.S. Fidelis. Ironically, anyone who benefited from the stolen funds had to forfeit their possessions.

    Miyong’s parents (Chun and Insook Kim) reside in Sacramento, California. What’s interesting is they haven’t paid any taxes on the “gifts” and monthly stipends they received over the course of seven years. I wonder when the IRS will get a sniff of this and pursue this matter??

  2. This guy has the moral character of a snake! I should know, I dated him. He married my BF behind my back and had four kids with her after dumping me when he found out I was pregnant! My baby did not survive, but I bet his crack habit did! I will pray for him and his family.
