My wife is mexican, she left me with a credit card debt of 18000, she is now in mexico? is there a way to make her responsible for what she owes?

We got married on 2001, I am legal in USA, but she was not, the thing is that as long as you have a job you can get credit, that is what she did, now she went back to mexico and left me with that huge debt, do I have to respond for that? is there a way to track her down and make her pay? I know where she is living now.

I have a huge debt myself, barely making payments. If I file for a bankruptcy will I lost my house?

That is the only asset I have. I will pay off my house in about 7 years.

  1. Hi Jose,

If the 18k in credit card debts are only in your wife’s name, you probably do not have a legal obligation to the debts. Please be certain you are not a cosigner on the accounts.

If you file chapter 7 bankruptcy, you will need to look at your state exemption for how much home equity can be exempted before the trustee sells the asset to pay your creditors. I encourage you to speak to a local bankruptcy attorney and learn how bankruptcy will apply to your specific issues and get all your questions answered.

Best of success on your debt relief journey!
