Hardship Letter

My wife and I went into Chapter 13 Bankruptcy 17 months ago, and we will be in this program for another three years. The Ch 13 process dictates that any excess income we generate (Currently $200 per month) goes directly to the Bankruptcy Administrator. We have barely been getting by and now my car, a 1996 Mercedes, has a bad transmission that does not shift correctly, a speedometer that does not always work and the car has a head gasket leak. The problems are too serious to repair. If I am to replace this car, I will need to save some money from our current expenses.

Another lesser issue is that the school that Cathy teaches at is closing and moving to a new location. The enrollment has continued to go and there is uncertainty about her future employment.

I am 73 years old and my wife is 63. Because of my age, I am less capable of doing physical work and with the bad economy, I cannot get a job. We have been in our home for over 20 years and wish to be able to stay here until we die. If my wife is to ever retire we need to get the monthly mortgage payment amount reduced. The current mortgage interest was lowered a few years ago, but is scheduled to go back up in a few years.

I wish to take advantage of the current low interest available and have our mortgage modified to give the savings we need to survive.
